Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Monterey County Laguna Seca Representative to execute Amendment No. 2 to the Standard Agreement with Star Sanitation, LLC to continue to provide fence rental and services for WeatherTech® Raceway at Laguna Seca, Request for Proposals #10715, to extend the Agreement term from March 28, 2019 through March 31, 2025 and increase the not to exceed by $40,000 for an amended not to exceed sum of $225,000; and

b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three future amendments to the Agreement where the total of each amendment does not exceed 10%, or $22,500 of the total agreement amount and does not significantly change the scope of work, subject to County Counsel approval for a total aggregate not to exceed sum of $292,500.

 

SUMMARY/DISCUSSION:

Star Sanitation, LLC (Star Sanitation), a local company, was selected to provide fence rental and services at WRLS during a competitive selection process through Request for Proposals (RFP) #10715 in accordance with County policies and all local, state, and federal laws.  On March 21, 2019, the Standard Agreement was executed with a five-year term from March 28, 2019 through March 27, 2024, and a total not to exceed sum of $100,000 (Attachment A). Amendment No. 1 was executed on September 21, 2022 to increase the not to exceed sum to$185,000 (Attachment B).  The proposed Amendment No. 2 will increase the not to exceed sum by $40,000, for an amended not to exceed sum of $225,000, and extend the Standard Agreement term for one additional year to March 31, 2025.

 

WeatherTech® Raceway at Laguna Seca (WRLS) hosts many annual events that attract more than 325,000 local, national, and international visitors annually.  During these events, fencing services are essential to operations.

 

Staff requests the Board of Supervisors approve and authorize the Monterey County Laguna Seca Representative to execute the proposed Amendment No. 2 to the Standard Agreement with Star Sanitation to increase the not to exceed sum by $40,000 for an amended not to exceed sum of $225,000 and extend the Agreement term through March 31, 2025 with a total aggregate not to exceed sum of $292,500.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed Amendment No. 2 as to form and fiscal provisions, respectively.

 

FINANCING:

Costs associated with Amendment No. 2 will be incurred over 2 fiscal years, FY 2023-2024 and FY 2024-2025.  The FY 2023-2024 Adopted Budget includes sufficient appropriations in Laguna Seca Recreation Area Fund 453, Budget Unit 8579, Appropriation Unit PFP067, to cover anticipated expenditures for the year.  The FY 2024-2025 Recommended Budget will include sufficient appropriations to cover anticipated costs for that year.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors Strategic Initiatives for Infrastructure and Public Safety.  The safety of event participants and the public is a priority at WRLS events.  Temporary fencing provides crowd control/containment, enhances safety, and protects park infrastructure during events.
