Title: a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Ratify and approve Amendment No. 1 to Standard Agreement between County of Monterey and Dave's Repair Service to continue to provide on-call repair services and include services associated with enhanced vapor recovery Dual Point Phase 1 System retrofits and annual testing at various County fueling sites in the amount of $62,498.93, for a total amount not to exceed $112,498.93 and extend the term from June 30, 2014 to June 30, 2015; and
 
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 1 to the Standard Agreement and up to three (3) future amendments that do not significantly alter the scope of work or change the approved Agreement amount.  
 
SUMMARY/DISCUSSION:
Amendment No. 1 to the Standard Agreement (Agreement) between County of Monterey and Dave's Repair Service allows for the addition of enhanced vapor recovery Dual Point Phase 1 System retrofits, annual underground storage tank monitor certification, spill bucket and LLD testing, and annual underground storage tank vapor testings.  The enhanced vapor recovery Dual Point Phase 1 System retrofits are required by the Monterey Bay Unified Air Pollution Control District and must be completed by June 30, 2014.  Amendment No. 1 will increase the Agreement by $62,498.93, for a total amount not to exceed $112,498.93, and extends the term from June 30, 2014 to June 30, 2015.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Auditor-Controller, have reviewed and approved Amendment No. 1 as to form and legality, and fiscal provisions, respectively.
 
Due to the urgency and nature of the required services and in order to remain compliant with State and Federal regulations, the County's Contracts/Purchasing Officer approved Dave's Repair Service to move forward with this work prior to receiving approval by the Board of Supervisors.
 
FINANCING:
There is no financial impact to the General Fund.  Sufficient appropriations are available in the RMA - Public Works - Fleet (Fund 001, Department 3000, Unit 8185, Appropriations Unit RMA 007) to finance Amendment No. 1.  To remain compliant and avoid costly penalties, funding will be made available temporally from the Vehicle Replacement Program Funds and recoverable from departments that require this upgrade but are not under Fleet's control.
