b. Direct the Clerk of the Board to publish a

hearing notice in THE CALIFORNIAN,

THE SOLEDAD BEE, THE REGISTER-

PAJARONIAN and the KING CITY

RUSTLER at least ten clays prior to the

date set for the hearing 

Upon motion of Supervisor Calcagno, seconded by Supervisor Salinas, and carried by

those members present, the Board hereby;

a. Set a date for a public hearing on June 14, 2011, at 1:30 P.M., to adopt the Fiscal

Year 2011-12 benefit assessments for Zones 1,1A, 8, 9, 12, and 17, and;

b. Direct the Clerk of the Board to publish a hearing notice in THE CALIFORNIAN,

THE SOLEDAD BEE, THE REGISTER-PAJARONIAN and the KING CITY

RUSTLER at least ten days prior to the date set for the hearing.

NOTICE IS HEREBY GIVEN that pursuant to Section 6066 of the Government Code of

the State of California and Monterey County Water Resources Agency Ordinance No. 2626,

superseded by Ordinances 3878 and 3882, which changed the rates but left all other provisions of

2626 unchanged, the Board of Supervisors of the Monterey County Water Resources Agency on

behalf of Zone 1 has elected to collect benefit assessments to cover costs not otherwise offset by

other revenue for the Fiscal Year 2011-12 on the tax roll in the same manner as general taxes,

and has caused to be filed with its Clerk a written report containing a description of each parcel

of real property in Zone 1, and the amount of such benefit assessment on each property for Fiscal

Year 2010-11 for each such parcel.

NOTICE IS FURTHER GIVEN that on Tuesday, the 14th day of June, 2011, at the

hour of 1:30 PM at the regular meeting place of the Board of Supervisors of the Monterey

County Water Resources Agency, Supervisors' Chambers, Courthouse, 168 West Alisal Street,

CALIFORNIAN, THE SOLEDAD BEE, THE REGISTER-PAJARONIAN and the

KING CITY RUSTLER at least ten days prior to the date set for the hearing.

DEPARTMENT: Water Resources Agency

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Set a date for a public hearing on June 14, 2011, at 1:30 P.M., to consider adopting the Fiscal

Year 2011-12 benefit assessments for Zones 1, 1 A, 8, 9, 12, and 17, and;

b. Direct the Clerk to the Board to publish a hearing notice in the SALINAS CALIFORNIAN,

THE SOLEDAD BEE, THE REGISTER-PAJARONIAN and the KING CITY RUSTLER at

least ten days prior to the date set for the hearing.

SUMMARY:

The Board is being asked to set a public hearing to adopt flood control benefit assessment for Fiscal

Year FY) 2011-12. Attachment 1 shows the maps of each zone; Attachment 3 shows the proposed

FY 2011-12 assessment rates that have been recommended by the Agency's Board of Directors. The

proposed rates will remain unchanged from the rates approved for FY 2010-11. After the public

hearing, the Board may approve or lower any of the assessments, but may not raise them.

DISCUSSION:

On November 4, 1980, the electorate of the Agency's Zones 8, 9, and 12 approved the levying of

flood control benefit assessment in accordance with ordinance 2626, adopted by the Board on May

20, 1980. On June 5, 1984 the electorate of the Agency's Zone 17 approved the levying of benefit

assessments in accordance with Ordinance 2974, adopted by the Board on February 28, 1984. On

July 16, 1996, and July 23, 1996, the Board of Supervisors passed Ordinances 3878 and 3881

creating flood control benefit assessments for Zones 1 and 1 A, respectively. The Fiscal Year 2011-12

assessments for Zones 1, 1A, 8, 9, 12, and 17 will remain the same as Fiscal Year 2010-11 cz as

shown in Attachment 3.

The assessment will be used to fund operations and maintenance work in Zones 1, 1 A, 8, 9, 12, and

17. Attachment 4 describes the work to be performed in each of the zones. Also attached are copies

of notices of public hearing.

OTHER AGENCY INVOLVEMENT:

On April 25, 2011, the Agency Board of Directors approved Flood Control Benefit Assessments for

Zones 1, 1 A, 8, 9, 12, and 17; and recommended the schedule of assessments shown in Attachment 3

to the Board of Supervisors. County Counsel has reviewed this board report as to form.
