RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Award a contract to Papich Construction Company, Inc., the lowest responsible bidder, for the Bradley Road Bridge, Project No. 3852, in the total amount of $8,390,000.

b. Approve the Performance and Payment Bonds executed and provided by Papich Construction Company, Inc.

c. Authorize a contingency, not to exceed ten percent (10%) of the contract amount or $839,000 to provide funding for approved contract change orders.

d. Authorize the Director of Public Works, Facilities and Parks to execute the contract and, subject to the terms of the Public Contract Code and Board Policies as applicable, approve change orders to the contract that do not exceed ten percent (10%) of the original contract amount and do not significantly change the scope of work; and

e. Authorize the Director of Public Works, Facilities and Parks to execute a Certificate of Completion and record a Notice of Completion with the County Recorder when the Director determines that the contract is complete in all respects in accordance with Plans and Special Provisions for the construction of the Bradley Road Bridge, Project No. 3852.

 

SUMMARY:

Approval of the recommended action will authorize the Monterey County Department of Public Works, Facilities and Parks (PWFP) to award the Bradley Road Bridge Scour Repair Project construction contract to Papich Construction Company, Inc., as the lowest responsible, responsive bidder and proceed with construction.  The Bradley Road Bridge Scour Repair Project (Project) will address existing scour issues by installing scour countermeasures to protect the Bradley Road Bridge (bridge) piers that are currently exposed due to scour (Bridge No. 44C-0050).

 

The Bradley Road Bridge is located approximately five (5) miles north of the Monterey County/San Luis Obispo County border, just west of Bradley and approximately ¼-mile east of Highway 101 in an unincorporated portion of Monterey County.

 

DISCUSSION:

The proposed project is to address existing scour issues by installing scour protection on the substructure of the Bradley Road Bridge (State Bridge No. 44C-0050) County Bridge No. 448.  The proposed scour repair project on the existing bridge over the Salinas River will upgrade the Bradley Road bridge to meet current Caltrans Standards. 

On March 01, 2022, the Board of Supervisors approved the Plans and Special Provisions for the Bradley Road Bridge Scour Repair Project, Project No. 3852.  The project was subsequently advertised, and bids were opened on April 14, 2022. Two (2) bids were submitted for the project. The lowest responsible, responsive bidder was Papich Construction Company, Inc., with a bid of $8,390,000.  The second bidder was Granite Rock Company, Inc., with a bid amount of $10,707,221.50.

 

In compliance with the California Environmental Quality Act (CEQA), PWFP filed a Final Initial Study and a Mitigated Negative Declaration (IS MND) on March 24, 2020.  Caltrans, as the designated lead for the National Environmental Policy Act (NEPA), determined that the Project is categorically excluded from having to prepare an Environmental Assessment (EA) or an Environmental Impact Statement (EIS).  Caltrans approved the NEPA Categorical Exemption/Categorical Exclusion Determination on August 21, 2018.

 

In compliance with the California Environmental Quality Act (CEQA), PWFP filed an Initial Study Mitigated Negative Declaration (IS/MND) on March 24, 2020.  Also, Caltrans, as the designated lead for the National Environmental Policy Act (NEPA), determined that the Project is categorically excluded from having to prepare an Environmental Assessment (EA) or an Environmental Impact Statement (EIS).  Caltrans approved the NEPA Categorical Exemption/Categorical Exclusion Determination on August 21, 2018.

 

Construction is anticipated to begin in June 2022 and is scheduled to take 148 working days, meaning it would be completed in FY 2022-23.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management, and Auditor-Controller’s Office have reviewed and approved the contract documents in the Project Special Provisions as to form, insurance and indemnification provisions, and fiscal provisions respectively.

 

FINANCING:

The total estimated project cost, including engineering design, environmental documentation and permitting, right-of-way, utility relocation, and construction is $8,390,000. The project is largely funded by the Federal Highway Administration’s (FHWA) Highway Bridge Program (HBP).  The federal funds require an 11.43% local match that will be provided by the State Toll Credits Fund ($958,977) and Measure X funds ($149,235).  See Attachment B for further details on the Project budget.

 

However, given programming funding constraints the federal funds for the construction phase will not be available until the next federal fiscal year and thus the Road Fund will need to cash flow the Project construction expenses.  The HBRR funding is programmed to reimburse the Road Fund in FY 2022-23 federal fiscal year for project expenditures cash-flowed by local Road Fund revenue streams.  The amount to cashflow pending reimbursement would be for the construction phase and is estimated at $10,016,050.  There are currently sufficient appropriations in the adopted FY 2021-22 Road Fund 002, Appropriation Unit PFP 004 budget to finance the construction phase of the Project in the current year as well in the recommended budget for FY2022-23.
