Authorize the County Purchasing Agent or their designee to execute Amendment No. 6 to Agreement No. A-16556 with SCRAM of California, Inc. to provide electronic monitoring products and services for Probation clients, for one additional year, for a revised term of June 1, 2023 through June 30, 2027, and to increase the Agreement’s amount by $744,580 for a revised total Agreement amount not to exceed $1,791,495; and
b. Authorize the County Purchasing Agent or designee to execute future amendments to the Agreement where the total amendments do not exceed 10% ($179,150) of the Agreement amount and do not significantly change the scope of services, for a not to exceed maximum amount of $1,970,645.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Authorize the County Purchasing Agent or their designee to execute Amendment No. 6 to Agreement No. A-16556 with SCRAM of California, Inc. to provide electronic monitoring products and services for Probation clients, for one additional year, for a revised term of June 1, 2023 through June 30, 2027, and to increase the Agreement’s amount by $744,580 for a revised total Agreement amount not to exceed $1,791,495; and

SUMMARY:
The County of Monterey Probation Department entered into Standard Agreement No. A-16556 with SCRAM of California, Inc. for the provision of electronic monitoring services for Probation clients. The initial contract term was June 1, 2023, through December 31, 2023. Since that time, the Agreement has been amended five times to ensure the continued delivery of court-mandated monitoring services.
DISCUSSION:
The Probation Department continues to require electronic monitoring services to support supervision of clients as ordered by the Monterey County Superior Court and as a condition of probation for various offender populations. Electronic monitoring serves as an intermediate sanction and an alternative to detention. The number of clients requiring monitoring fluctuates monthly based on operational needs. Additionally, the recent implementation of the Pre-trial Services Program under Senate Bill 129 has increased the number of individuals served under this Agreement.
To maintain service continuity, Amendment No. 6 has been prepared to extend the Agreement term by an additional year through June 30, 2027, and to increase the not-to-exceed amount by $744,580, resulting in a revised total contract amount not to exceed $1,970,645. Additionally, the amendment updates the rate schedule to eliminate a tiered rate for the SCRAM Continuous Alcohol Monitoring + ETHERNET product and establish a set rate, which will result in a cost savings to the County.
Probation recommends that the Board approve Amendment No. 6 to Standard Agreement No. A-16556. Approval will ensure the continued provision of essential electronic monitoring services necessary for effective supervision and overall department operations.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
Amendment No. 6 was approved by the Office of County Counsel as to legal form and by the Auditor-Controller as to fiscal terms.
FINANCING:
Funding for this Agreement is fully provided by State Public Safety Realignment and SB 129 Pretrial monies. Sufficient appropriations and funding are included in Probation's FY 2025-26 Adopted Budget and FY 2026-27 Recommended Budget, for Appropriation Unit PRO001, Unit 8165. The recommended action results in no cost to the County General Fund.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
This recommendation aligns with the Board of Supervisor Strategic Plan Goals of Safe and Resilient Communities by supporting Probation’s Electronic Monitoring Program. Probation utilizes electronic monitoring as a probation supervision tool for a number of different offender populations. Electronic monitoring serves as an intermediate sanction/detention alternative, as well as a tool to enhance public safety, by assisting officers in monitoring high risk populations in the community.
