a. Approve and authorize the Director of Health Services or the Assistant Director of Health Services to execute Amendment No. 3 to Agreement A-16677 with Thermo Electron N. America, LLC, for the purchase of new laboratory equipment and preventative maintenance, extending the term for an additional one (1) year, with a new term of January 12, 2024, through December 31, 2028, and increasing the funds by $63,435.78 for a total aggregate Agreement amount of $235,164; and
b. Approve and authorize the Assistant Director of Health Services or Assistant Director of Health Services to sign up to three future amendments where the combined amendments do not exceed 10% ($23,516) of the original amount and does not significantly change the scope, total not to exceed a maximum of $258,680.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health Services or the Assistant Director of Health Services to execute Amendment No. 3 to Agreement A-16677 with Thermo Electron N. America, LLC, for the purchase of new laboratory equipment and preventative maintenance, extending the term for an additional one (1) year, with a new term of January 12, 2024, through December 31, 2028, and increasing the funds by $63,435.78 for a total aggregate Agreement amount of $235,164; and

SUMMARY:
The County of Monterey Health Department, Public Health Bureau, Consolidated Environmental Laboratory is an Environmental Lab Accreditation Program (ELAP)-certified laboratory that routinely analyzes drinking water for bacterial and chemical contaminants. The Consolidated Environmental Laboratory also conducts tests on samples derived from the environment for the purpose of assuring safe food, drinking water, reclaimed water, storm water run-off, and irrigation water.
DISCUSSION:
The Consolidated Environmental Laboratory seeks approval to enter into an Amendment of their existing Agreement with Thermo Electron North America, LLC, to purchase, install, and maintain an Dionex Inuvion RFIC system. This Amendment will improve the Environmental Laboratory’s customer service. The Inuvion is an ion analyzer for fluorides, nitrates, chlorides, and sulfates in water, which are some of the most requested tests by businesses and the public.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Office of the County Counsel has reviewed and approved this Agreement as to legal form. Auditor-Controller has reviewed and approved this Agreement as to fiscal provisions.
FINANCING:
This agreement is funded 32% by Public Health Environmental Lab fee revenue and 68% by Health Realignment. There are sufficient appropriations in the Health Department’s (001-4000-8124-HEA003) FY 2025-26 Adopted Budget.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
This Amendment aligns with the Strategic Plan Goal of Well-Being and Quality of Life. The County of Monterey Health Department’s ELAP-certified Consolidated Environmental Laboratory is essential for protecting public health by ensuring the safety of drinking water, food, and environmental resources. To meet increasing testing demands and detect harmful contaminants more effectively, the Environmental Laboratory seeks approval to acquire a Dionex Inuvion Ion Chromatograph, which will enhance efficiency and consolidate analyses.
