a. Authorize the Chief Executive Officer for Natividad Medical Center (NMC) or his designee to execute an agreement with Dynalabs, LLC for analytical laboratory testing of compounded pharmaceutical services at NMC for an amount not to exceed $32,000 with an agreement term retroactive to January 1, 2021 through December 31, 2025.
b. Approve the NMC Chief Executive Officer’s recommendation to accept non-standard indemnification and limitations on liability provisions within the agreement.

RECOMMENDATION:
It is recommended the Board of Supervisors:
a. Authorize the Chief Executive Officer for Natividad Medical Center (NMC) or his designee to execute an agreement with Dynalabs, LLC for analytical laboratory testing of compounded pharmaceutical services at NMC for an amount not to exceed $32,000 with an agreement term retroactive to January 1, 2021 through December 31, 2025.
b. Approve the NMC Chief Executive Officer’s recommendation to accept non-standard indemnification and limitations on liability provisions within the agreement.
SUMMARY/DISCUSSION:
Dynalabs specializes in laboratory quality assurance testing services of compounded medications. Natividad has used Dynalabs for several years and has been satisfied with their turnaround times and their customer service. NMC uses Dynalabs for sterility testing, potency testing, stability testing, endotoxin testing, and beyond use dating as required by state and federal law and regulation. Potency, beyond use dating, and stability testing help ensure patients receive a sufficient medication dose. Sterility and endotoxin testing ensure that the medications patients receive do not contain bacterial contamination. Through this testing not only are individual products tested but the quality of the compounding process itself is measured.
This new agreement replaces an older agreement with Dynalabs, LLC from 2015 and contains updated terms and pricing.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel has reviewed and approved this agreement as to form, and the Auditor-Controller has reviewed and approved as to payment provisions. The agreement has also been reviewed and approved by NMC’s Finance Committee on January 8, 2021 and by its Board of Trustees on January 8, 2021.
FINANCING:
The cost for this agreement is $32,000 of which $6,400 is included in the Fiscal Year 2020-21 Adopted Budget. Amounts for remaining years of the agreement will be included in those budgets as appropriate.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
Quality assurance testing, provided by Dynalabs, will ensure the quality of compounded medications enhancing the health of Monterey County residents who receive them.
