SUMMARY/DISCUSSION:

Pursuant to the California Health and Safety Code, Section 1797 et seq., the Monterey County Department of Health’s Emergency Medical Services (EMS) Agency is designated by the Monterey County Board of Supervisors as the local EMS Agency. The EMS Agency is responsible for emergency medical services (EMS) system coordination, medical oversight, and coordination of the delivery of EMS by provider organizations in Monterey County.  The EMS Agency is also responsible to establish policies and procedures approved by the Medical Director of the Local EMS Agency to assure medical control of the EMS system as well as for regulating Advanced Life Support (ALS), Critical Care Transport (CCT), and Basic Life Support (BLS) air ambulance services and EMS service providers within Monterey County, and for authorizing ALS, CCT, and BLS air ambulance response and transport within the county. 

 

Pursuant to California Health and Safety Code Section 1797.202, Every local EMS Agency is required have a full- or part-time licensed physician and surgeon as Medical Director, who has substantial experience in the practice of emergency medicine, to provide medical control and to assure medical accountability throughout the planning, implementation and evaluation of the EMS system.

 

The Service Agreement represents the contractual instrument that will permit the County to engage the services of a highly qualified emergency physician to serve as the County’s EMS Agency Medical Director. The proposed Agreement includes all requirements necessary to ensure consistent and appropriate medical control of pre-hospital personnel, and medical guidance in the overall planning and management of the EMS Agency. The proposed Agreement is for securing the professional services of Dr. John Beuerle, M.D., M.S. an independent contractor. Within the context of this Agreement, Dr. Beuerle has agreed to maintain and provide proof of insurance meeting the County’s requirements for professional liability insurance. The Health Department is requesting a modification of the County’s requirement for Business Automobile Liability Insurance as Dr. Beuerle’s insurance provider has refused to issue a certificate naming the County as additionally insured. The Department does feel that a modification is appropriate as Dr. Beuerle will be on County property a maximum 400 hours/year for the contract period and will not be transporting either County personnel or property in his vehicle.

 

Finally, the Health Department is requesting modification of both the County’s Comprehensive General Liability and Workers’ Compensation Insurance provisions for the reasons set forth in Exhibit B to the Professional Services Agreement.

 

This work supports the Monterey County Health Department 2018-2022 Strategic Plan initiatives 2. Enhance public health and safety through prevention and 4. Engage MCHD workforce and improve operational functions to meet current and developing population health needs.  It also supports one of the ten essential public health services, specifically, 7. Link people to needed personal health services and assure the provision of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed the Agreement as to form and legality.

 

FINANCING:

This action does not impact General Fund contribution.  The cost of services to be provided under the proposed Agreement would be covered by CSA-74 special tax (fund 092).  The funds for this Agreement for FY 2019-20 were included and for FY 2020-21, and FY 2021-22 will be included in the Health Department’s Emergency Medical Services Bureau (HEA 006, Unit 8109) respective FY 2019-20, FY 2020-21, and FY 2021-22 Recommended Budgets.
