RECOMMENDATION
 
a.      Receive the Certified Statement of Votes cast and declare the results of the June 5, 2012 Presidential Primary Election;
b.      Declare elected the candidates to each office under the Board's jurisdiction; and
c.      Appoint in lieu of election the candidates to their respective offices that have insufficient nominees to cause an election.
 
SUMMARY
The Elections Department requests the Board of Supervisors receive the Statement of Votes cast at the June 5, 2012 Presidential Primary Election within Monterey County, as certified by the Registrar of Voters. In addition, Elections requests that the Board declare elected or appoint in lieu of election the candidates for offices under their jurisdiction at the June 5, 2012 Election.
 
DISCUSSION
In accordance with Elections Code Section 15372, the Registrar of Voters is submitting the certified Statement of Votes to your Board.  Pursuant to Elections Code Section 15374, the Statement of Votes shows:
·      the total number of ballots cast;
·      the number of votes cast at each precinct for each candidate and for and against each measure;
·      the total number of votes cast for each candidate and for and against each measure; and
·      the total number of votes cast in each city, assembly district, congressional district, senatorial district, State Board of Equalization district, and supervisorial district located in whole or in part in the county, for each office and proposition voted on within the state.
 
This Statement of Votes also reports vote by mail results by each voting precinct.
 
The Elections Department will also file a certified Statement of Votes with the California Secretary of State who shall compile the statements of all 58 counties and certify the statewide results and each local jurisdiction with candidates and/or ballot measures on the ballot.
 
Official Canvass of the Vote.  The official canvass was completed and the election certified on Tuesday, June 26, 2012.  The official canvass consisted of several steps, including an inspection of all materials and supplies returned from each polling place, processing and counting vote by mail, opt-out, and provisional ballots returned from each precinct, a reconciliation of signatures in rosters with votes recorded, a reconciliation of vote by mail ballots counted with the number of votes recorded, and a manual tally of the ballots tabulated by the voting systems at 1 percent of the precincts.  The 2007 conditional re-approval of voting systems also requires a 100% manual tally of all votes cast on any touch-screen voting machine.
 
Pursuant to Elections Code Sections 8140 and 15400, et seq., the Registrar of Voters recommends that the Board of Supervisors declare elected the candidates who received a majority of votes for Members of the Monterey County Board of Supervisors as detailed on the attached Board Order.
 
Pursuant to Elections Code Section 8141, if no candidate has been elected to a nonpartisan office pursuant to Section 8140, by receiving a majority of the votes cast, then the candidates for that office at the ensuing election shall be those candidates who received the next highest number of votes cast.  For the offices of District 1 and District 5 of the Board of Supervisors, the two candidates who received the highest number of votes in each contest shall be the candidates for their respective office at the November 6, 2012 election, as detailed on the attached Board Order.
 
Pursuant to Elections Code Section 8144, the Registrar of Voters recommends that the Board of Supervisors declare elected the candidates who received the highest number of votes for Green Party County Council, as detailed on the attached Board Order.
 
Pursuant to Elections Code Sections 7228 and 7423, the Registrar of Voters recommends that the Board of Supervisors appoint in lieu of election the candidates for the Democratic Party County Central Committee and California Republican Party County Central Committee where there were insufficient nominees to cause an election, as detailed on the attached Board Order.
 
Copies of the Statement of Votes are on file with the Clerk of the Board.
 
OTHER AGENCY INVOLVEMENT:
None. However, due to late submission of this Board Report, the CAO Budget and Analysis Division was not provided adequate time to fully review for potential fiscal, organizational, policy, or other implications to the County of Monterey.
