RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a resolution amending the Juvenile Justice Coordinating Council bylaws.

 

SUMMARY/ DISCUSSION:

The Juvenile Justice Coordinating Council (JJCC) is legislatively mandated by Welfare and Institutions (W&I) Code 749.22, which requires counties to establish a juvenile justice coordinating council to develop a comprehensive, collaborative, multiagency local action plan and implement a continuum of county-based responses to prevent and reduce juvenile crime.

 

The code also establishes the minimal membership for JJCC and indicates that the Chief Probation Officer will serve as council Chair for the duration of his or her appointment. Other members include one representative each from the district attorney's office, the public defender's office, the sheriff's department, the board of supervisors, the department of social services, the department of mental health, a community-based drug and alcohol program, a city police department, the county office of education or a school district, and an at-large community representative.  In addition, the coordinating council includes representatives from nonprofit community-based organizations providing services to minors. 

 

The council membership is designed with a balanced and comprehensive approach, which integrates advocacy, treatment, and accountability, toward a continuum of graduated measures and programs designed to intervene with appropriate responses and different degrees of severity for at-risk youth and juvenile offenders.

 

In 2020, W&I Code 1995 mandated the creation of a subcommittee of the multiagency juvenile justice coordinating council to develop a plan describing the facilities, programs, placements, services, supervision, and reentry strategies that are needed to provide appropriate rehabilitation and supervision services for the in-custody youth realigned to counties from the State Division of Juvenile Justice (DJJ). The Chief Probation Officer serves as Chair of the subcommittee. Other members include one representative each from the district attorney’s office, the public defender’s office, the department of social services, the department of mental health, the county office of education or a school district, and a representative from the court. The subcommittee also includes no fewer than three community members who shall be defined as individuals who have experience providing community-based youth services, youth justice advocates with expertise and knowledge of the juvenile justice system or have been directly involved in the juvenile justice system.

 

The current bylaws were approved in 2009. The proposed amendment to these bylaws includes language for the new subcommittee, lists the ex-officio and at-large members, and clarifies the process for member selection.  

 

The Juvenile Justice Coordinating Council adopted the revised bylaws on April 21, 2021; a copy of the revised bylaws is on file with the Clerk of the Board.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed the amendment for compliance to applicable law. The Juvenile Justice Coordinating Council approved the proposed bylaws at its meeting of April 21, 2021.

 

FINANCING:

There is no impact on the County General Fund.
