a. Approve and authorize the Monterey County Laguna Seca Representative to execute a Standard Agreement between Cresco Equipment Rentals and the County of Monterey for Golf Cart Rentals and Service for WeatherTech® Raceway at Laguna Seca, with a term beginning April 1, 2022 through December 31, 2022, for an amount not to exceed $150,000; and
b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to the Standard Agreement where the total amendments do not exceed ten percent (10%), or $15,000, of the Agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a Standard Agreement between Cresco Equipment Rentals and the County of Monterey for Golf Cart Rentals and Service for WeatherTech® Raceway at Laguna Seca, with a term beginning April 1, 2022 through December 31, 2022, for an amount not to exceed $150,000; and
b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to the Standard Agreement where the total amendments do not exceed ten percent (10%), or $15,000, of the Agreement amount and do not significantly change the scope of work, subject to County Counsel approval.
SUMMARY/DISCUSSION:
Founded in 1984 in Martinez, CA, Cresco Equipment Rentals (Cresco) delivers a comprehensive inventory of rentals and a knowledgeable staff properly trained for equipment maintenance and safety protocols. Currently, Cresco has 19 locations throughout Northern California.
This request supports the use of Cresco Equipment Rentals for golf cart rentals and service during events at WeatherTech® Raceway at Laguna Seca. Per the proposed Standard Agreement (Agreement), Cresco shall provide all golf carts in good working order and condition and provide on-site staff for mechanical service needs that may arise during the rental period. Cresco shall also supply and bill third-party customers for requested services during any event at WeatherTech® Raceway at Laguna Seca during the term of this Agreement. Cresco will be 100% responsible for managing all third-party rentals and will obtain proof of insurance documentation on each third-party renter. County Code Section 2.3.2070 allows the County Purchasing Officer to rent personal property without going through the bidding process.
Staff requests the Board of Supervisors approve and authorize the Monterey County Laguna Seca Representative to execute the Standard Agreement to ensure golf cart rental and services are available during major events at WeatherTech® Raceway at Laguna Seca and up to three future amendments to the Agreement.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed Agreement as to form and fiscal provisions, respectively. Risk Management reviewed and approved the insurance coverage and limits.
FINANCING:
The cost of the contracted services provided by Cresco is not to exceed $150,000 for the duration of the Agreement. There is sufficient funding in Laguna Seca Recreation Area Fund 453, Appropriation Unit CAO046, to cover the increased fees in this Agreement in Fiscal Year 2021-22. Future cost for services for the remainder of this Agreement will be included in Fiscal Year 2022-23 Recommended Budget in Fund 453, under its new Appropriation Unit PFP067.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiatives for Health & Human Services and Public Safety. The golf carts provided by this Agreement will be used by participants and event organizers for safe transportation on the property. This transportation mode will keep guests off the roadway, which does not have a pedestrian travel area, and allow for ADA-accessibility on the property.
