Approve Amendment No. 2 to Professional Services Agreement No. A-16363, Multi-Year Agreement #3200*7167, with CONSOR North America, Inc. to include additional professional engineering services for the Prunedale Roundabout Project, Request for Proposals #1176, with no extension to the term of June 6, 2023 to June 5, 2026 and increase the not to exceed maximum by $185,893 to a total amount of $1,233,366; and
b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 2 to Professional Services Agreement No. A-16363 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the amount by more than 10% ($123,337) of the new approved Agreement amount of $1,233,366 bringing the potential overall aggregate not to exceed amount to $1,356,703 subject to review and approval as to form by the Office of the County Counsel and as to fiscal provisions by the Auditor-Controller’s Office.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 2 to Professional Services Agreement No. A-16363, Multi-Year Agreement #3200*7167, with CONSOR North America, Inc. to include additional professional engineering services for the Prunedale Roundabout Project, Request for Proposals #1176, with no extension to the term of June 6, 2023 to June 5, 2026 and increase the not to exceed maximum by $185,896 to a total amount of $1,233,366; and
b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 2 to Professional Services Agreement No. A-16363 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the amount by more than 10% ($123,337) of the new approved Agreement amount of $1,233,366 bringing the potential overall aggregate not to exceed amount to $1,356,703 subject to review and approval as to form by the Office of the County Counsel and as to fiscal provisions by the Auditor-Controller’s Office.
SUMMARY/DISCUSSION:
The Prunedale Roundabout Project (Project) consists of converting the existing T-intersection where Castroville Boulevard meets San Miguel Canyon Road into a three-legged roundabout with single approach and departure lanes. The Project will require transition improvements for all three existing roadway approaches and include new median islands, a centered circle with a truck apron, pedestrian/bicyclist crossings, overhead streetlighting, Class II bike lane facilities along San Miguel Canyon Road, traffic signs, striping, and pavement markings. The Project scope also includes community meetings and public outreach.
Additional services to the original scope of Professional Services Agreement (PSA) No. A-16363 between the County of Monterey and CONSOR North America, Inc. (CONSOR) are necessary to develop three roundabout alternatives for the Project. During preliminary design, CONSOR and County staff evaluated these alternatives and one of these alternatives was selected. During preparation of the 30% design submittal for the selected alternative, it became apparent that a large temporary retaining wall would be required to construct the roundabout. Following discussions with County staff in May 2024, County staff directed staff to develop roundabout configuration alternatives that precluded the need for a temporary retaining wall and thus reduce estimated roundabout costs by $800,000. County staff selected an alternative and directed CONSOR to resume design using this new roundabout configuration
PWFP staff recommends that the Board of Supervisors (Board) approve the proposed Amendment No. 2 (Attachment A) to the PSA to address the cost of redesigning the roundabout at its new location. Amendment No. 2 will increase the not to exceed maximum of $1,047,473 by $185,893 to a total amount of $1,233,366 with no extension to the term of June 6, 2023 to June 5, 2026.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved the proposed Amendment No. 2 as to form, and fiscal provisions, respectively.
FINANCING:
In 2020, the County’s Department of Public Works, Facilities and Parks (PWFP) submitted a Cycle 10 Local Highway Safety Improvement Program (HSIP) grant application to Caltrans for the Project. The HSIP is a core State and Federal-aid program for the purpose of achieving a significant reduction in fatalities and serious injuries on all public roads. On September 29, 2021, an allocation letter from the Caltrans Division of Local Assistance was received by the County awarding $2,189,600 to PWFP for the Project; and on March 22, 2022, the Board approved and authorized the Director of PWFP to enter into a Master Agreement Administering Agency-State Agreement for State-Funded Projects (Agreement No. 05-5944S21) with Caltrans.
The total estimated cost of the Project including design engineering, environmental, right of way, and construction is $3,267,569. Thus, the Project is largely funded by HSIP in the amount of $2,189,600 and local funds through Measure X in the amount of $597,474 and Traffic Impact Fees in the amount of $185,000 (refer to Attachment E - Project Budget). Sufficient appropriations in the amount of $215,552 are available for this Project phase in the Public Works Annual Work Program for FY 2024-25 Budget for Fund 002, Unit 8558.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board’s Strategic Initiatives for Infrastructure and Public Safety. Proceeding with design of the Project supports roadway improvements and public safety by providing adequate County infrastructure and by promoting public safety on County roads by reducing traffic and the high number of collisions, and further increasing visibility and sidewalk connectivity for pedestrians.
