RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Certify that the Board has considered the Addendum together with the General Plan FEIR;
b. Adopt an ordinance (Attachment B) to amend Title 21 (non-coastal zoning ordinance) of the Monterey County Code to:
1. Add Chapter 21.63 to establish a process for adoption of design guidelines and to specifically provide for adoption of design guidelines for exterior lighting.
2. Revise the site development standards in all non-coastal zoning districts to require review and approval of exterior lighting by the RMA- Director of Planning for consistency with the Design Guidelines for Exterior Lighting; and
c. Adopt a resolution (Attachment D) to adopt the Design Guidelines for Exterior Lighting which defines lighting terms and details specific performance criteria to implement Policy LU-1.13 of the 2010 Monterey County General Plan.
SUMMARY:
The County is beginning to develop a set of Design Guidelines. As part of those actions, the ordinance establishes a new chapter in the County Code to authorize the Board to adopt such guidelines by resolution. We expect to have guidelines related to site design, ridgeline development, and neighborhood character in addition to exterior lighting.
Development of the proposed exterior lighting criteria implements the 2010 General Plan policies. Land Use Element Policy LU-1.13 calls for the development of exterior lighting criteria in the form of enforceable design guidelines, and this ordinance provides specifically for the adoption of design guidelines for exterior lighting. The ordinance provides for enforceability of the guidelines and makes them applicable to exterior lighting in non-coastal zoning districts. The Design Guidelines for Exterior Lighting and ordinance are intended to work hand in hand; the Design Guidelines briefly touch on energy efficiency and best management practices, describe performance criteria that will achieve the General Plan policies, and provide examples of acceptable lighting fixtures. The ordinance outlines a process for review of exterior lighting that requires consistency with the Design Guidelines, details submittal requirements, and lists exceptions to the regulatory standards.
Previous to the Board of Supervisors’ consideration, staff met with stakeholders such as the Streamlining Task Force and Monterey Institute of Research and Astronomy, conducted a public workshop and hearing before the Planning Commission, and reached out to the Monterey County Sheriff’s office for review. Staff considered any feedback received and incorporated revisions as necessary. On November 18, 2015, the Planning Commission conducted a public hearing on the ordinance and proposed guidelines and recommended that the Board of Supervisors consider an addendum to the FEIR for the General Plan, adopt an ordinance amending Title 21, and adopt the Design Guidelines for Exterior Lighting.
