RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Chair to execute the Agreement re: Drainage and Flood Control Systems for the York Highlands Resubdivision / PLN100020 and PLN120024 for property located south of the intersection of State Highway 68 and York Road, Salinas, Greater Monterey Peninsula Area; and
b. Direct the Clerk of the Board to submit the Agreement Re: Drainage and Flood Control Systems to the County Recorder for filing.
SUMMARY/DISCUSSION:
On September 14, 2005, the Owner's predecessor in interest filed for record a final map for Phase VIII of the Monterra Ranch Subdivision in Volume 23, Cities and Towns, at Page 14 in the Office of the Recorder for the County of Monterey, State of California. Concurrent with the recording of the Phase VIII final map, the Owner's predecessor in interest also recorded an Agreement re: Drainage and Flood Control Systems on September 14, 2005 as Document Number 2005095834 in the Office of the Recorder for the County of Monterey, State of California.
On December 1, 2005, the Owner's predecessor in interest filed for record a final map for Phase X of the Monterra Ranch Subdivision in Volume 23, Cities and Towns, at Page 16 in the Office of the Recorder for the County of Monterey, State of California. Concurrent with the recording of the Phase X final map, the Owner's predecessor in interest also recorded an Agreement re: Drainage and Flood Control Systems on December 1, 2005 as Document Number 2005127221 in the Office of the Recorder for the County of Monterey, State of California.
On October 18, 2011, the Board of Supervisors of the County of Monterey approved a Combined Development Permit including a vesting tentative resubdivision map for the resubdivision of properties located within Monterra Ranch Phase X and a portion of Monterra Phase VIII under the name of York Highlands Resubdivision. The purpose of this action is to amend the previous Agreement re: Drainage and Flood Control Systems and to fulfill Condition Number 57 for the York Highlands Resubdivision.
FINANCING:
Funding for staff time associated with this project is included in the FY11-12 Final Budget for the Water Resources Agency. MCWRA will ensure funding is budgeted in ensuing years.
