a. Approve and authorize the Contracts/Purchasing Officer or their designee to execute a Standard Agreement with Daniels Sharpsmart, Inc. dba Daniels Health to provide hazardous waste disposal services including Sharps Disposal Management and Regulated Medical Waste Disposal for Monterey County Juvenile Hall and Youth Center for a term retroactive to January 1, 2025 through December 31, 2027 for an amount not to exceed $24,000; and
b. Authorize the Contracts/Purchasing Officer or their designee to sign future amendments to the Agreement provided that these amendments do not substantially change the Scope of Services and the total amount of the amendments does not exceed the Contracts/Purchasing Officer's signing authority amount of $200,000 with approval from the Office of the County Counsel.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer or their designee to execute a Standard Agreement with Daniels Sharpsmart, Inc. dba Daniels Health to provide hazardous waste disposal services including Sharps Disposal Management and Regulated Medical Waste Disposal for Monterey County Juvenile Hall and Youth Center for a term retroactive to January 1, 2025 through December 31, 2027 for an amount not to exceed $24,000; and
b. Authorize the Contracts/Purchasing Officer or their designee to sign future amendments to the Agreement provided that these amendments do not substantially change the Scope of Services and the total amount of the amendments does not exceed the Contracts/Purchasing Officer's signing authority amount of $200,000 with approval from the Office of the County Counsel.
SUMMARY/DISCUSSION:
The County of Monterey, Probation Department (Probation), operates two 24-hour/365 day juvenile detention facilities, Monterey County Juvenile Hall and Monterey County Youth Center (Juvenile Institutions). Each Juvenile Institution has a medical service area operated by Natividad Medical Center (NMC) staff. As medical services are provided in the Juvenile Institutions hazardous materials are collected and the proper disposal services are required.
The proposed Agreement with Daniels Sharpsmart, Inc. dba Daniels Health for hazardous waste disposal services including sharps disposal management and regulated medical waste disposal will allow for the proper disposal of services and will ensure compliance with all applicable laws, ordinances and codes concerning the disposal of contaminated bio-hazardous waste is adhered to.
For several years, Daniels Health has provided these services at the Juvenile Institutions, and they have proven to be reliable and capable of meeting the medical waste removal needs required. Probation recommends the approval of the Agreement with Daniels Sharpsmart, Inc. dba Daniels Health for a term retroactive to January 1, 2025 through December 31, 2027 and for an amount not to exceed $24,000. Although the Agreement is below the signing authority of the Contracts/Purchasing Officer, it requires Board of Supervisors approval due to its retroactive start date. Contract negotiations delayed the approval process as well as the tight schedule impacted by the observed holidays and winter recess.
OTHER AGENCY INVOLVEMENT:
The Agreement has been approved by the Office of the County Counsel as to form and by the Auditor-Controller’s Office as to fiscal terms.
FINANCING:
The associated funding and appropriations of $8,000 are included in the Probation Department’s FY 24-25 Adopted Budget (001-2550-PRO001-8163 and 001-2550-PRO001-8164). Amounts for the remaining years of the Agreement will be included the annual budget approval process. There is no additional cost to the County General Fund with this recommendation.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This recommendation aligns with the Board of Supervisor's Strategic Initiatives in the three key areas of Administration, Health & Human Services, and Public Safety. Hazardous waste removal ensures a clean, safe, and sanitary environment. The Agreement allows the Probation Department and NMC medical services to maintain compliance with regulatory agencies as far as the removal of hazardous/medical waste removal.
