RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a.  Approve a Professional Services Agreement with MNS Engineers, Inc. to provide construction management and inspection services for the Castroville Boulevard Overlay Project (Request for Proposals #10468), in an amount not to exceed $134,920.70 for a term to June 17, 2015, with the option to extend the Agreement for three (3) additional one (1) year period(s); and
 
b.  Authorize the Contracts/Purchasing Officer to execute the Professional Services Agreement and up to three (3) future amendments that do not significantly alter the scope of work or change the approved Agreement amounts.  
 
SUMMARY/DISCUSSION:
Retention of a consulting firm is necessary to assist the Resource Management Agency (RMA) - Public Works in managing the Castroville Boulevard Overlay Project.  
 
MNS Engineers, Inc. was selected and hired for their expertise and capabilities necessary to provide construction management and inspection services for the Castroville Boulevard Overlay Project under a Professional Services Agreement (PSA) through a competitive selection process in accordance with County policies and State laws (under Request for Proposals (RFP) #10468) for an amount not to exceed $134, 920.70 for a term to June 17, 2015, with the option to extend the Agreement for three (3) additional one (1) year period(s).  Additionally, MNS Engineers, Inc. will also provide and coordinate the materials testing necessary for materials acceptance and quality assurance for the Project.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller have reviewed and approved the PSA as to form and legality, and fiscal provisions, respectively.  Due to the late submission of this Board Report, the CAO Budget and Analysis Division was not provided adequate time to fully review for potential fiscal, organizational policy, or other implications to the County of Monterey.
 
FINANCING:
There is no financial impact to the General Fund.  Total estimated project cost, including project management, engineering, and construction, is $1,696,966.  The project is funded from Gas Tax in the amount of $119,466 and a portion of the Board approved allocation of Transient Occupancy Tax (TOT) to the Road Fund in the amount of $1,577,500.  The Gas Tax contribution is to fund the majority of the contingency, for approved contract change orders.  The TOT to the Road Fund is based on the formula approved by the Board as part of the FY 2013-14 Adopted Budget.  In FY 2013-14, the approved formula provides 20% of the County's FY 2012-13 estimated year-end TOT revenue to the Road Fund to help improve and maintain County roads.  Base on this formula, the current year TOT to the Road Fund is approximately $3,577,500, of which $2,000,000 is assigned to the County's Seal Program and $1,577,500 has been assigned to this project.
 
This project was anticipated to be completed in FY 2013-14 when the FY 2014-15 Recommended Budget was developed.  As such, this project was not included in the FY 2014-15 budget and is not reflected in the FY 2014-15 Road Fund work plan.  There are sufficient appropriations available to complete this project based on the project budget schedule.  During the FY 2014-15 mid year review, staff will evaluate if there is a need to return to the Board to modify the budget, as a result of this project slipping into FY 2014-15.
