RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Adopt Plans and Special Provisions for the San Juan Grade Road Slope Repair at Milepost (MP) 8.63 Project, Project No. 6111; and
b. Authorize the Director of Public Works, Facilities and Parks to advertise the “Notice to Bidders” in the Monterey County Weekly.
SUMMARY:
Adopting the Plans and Special Provisions and authorizing the Public Works, Facilities and Parks Department (PWFP) to advertise the San Juan Grade Road Slope Repair at MP 8.63, Project No. 6111 (Project), will allow the PWFP to proceed with the construction phase of the Project and solicit construction bids. PWFP will return to the Board after opening bids and determining the lowest responsible bidder to award the Project.
DISCUSSION:
During the winter storms of 2017, a number of county roads were affected by the heavy rains and excessive storm water flows. On April 24, 2018, the Board of Supervisors approved a list of 2017 Winter Storm Projects that were obligated for reimbursement. Since that time, staff has been providing update reports to the Capital Improvement Committee, Budget Committee, and Board. This repair site is on that 2017 Winter Storm Projects list. The Project consists of the installation of a block wall system, drainage system, slope repair and roadway paving, including but not limited to clearing and grubbing, and traffic control. Project limits are along San Juan Grade Road three and a half miles north of the intersection with Crazy Horse Canyon Road.
The bid opening is set for July 8, 2022, at 3:00 p.m., in the Board of Supervisors’ Chambers, Monterey County Government Center, 168 West Alisal Street, 1st Floor, Salinas, California 93901. Project construction is scheduled to begin in September 2022.
In compliance with the California Environmental Quality Act (CEQA), PWFP staff filed a Notice of Exemption on May 9, 2022. The project has been determined to be an Emergency Project from CEQA because it is to perform repairs to publicly owned service facilities necessary to maintain service essential to the public health, safety or welfare (See CCR § 21080(b)(4); 15269(b)(c) Specific actions necessary to prevent or mitigate an emergency). Caltrans, as the designated lead for the National Environmental Policy Act (NEPA), determined that the Project is categorically excluded from having to prepare an Environmental Assessment (EA) or an Environmental Impact Statement (EIS). Caltrans approved the NEPA Categorical Exclusion Determination on February 8, 2018, and re-validated on April 15, 2022.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel-Risk Management, and Auditor-Controller have reviewed and approved the Special Provisions as to form and insurance and indemnification provisions, and fiscal provisions, respectively.
FINANCING:
When the 2017 Winter Storms were declared a Natural Disaster, Monterey County became eligible to apply for the Federal Highway Administration (FHWA) for funding through their Emergency Relief (ER) Program. The ER program provides funding to repair or reconstruct on the Federal Aid road network. Since FHWA funds are administered by Caltrans in California, Caltrans is considered the lead agency for National Environmental Policy Act (NEPA) and serves as the primary contact for other federal regulatory agencies. This road is on the Federal Aid road network.
The Caltrans administered FHWA-ER Program will fund 88.53% of the Project costs. Said FHWA-ER Program requires that the remaining 11.47% of the Project costs be funded through local funds. The total estimated Project cost, including Preliminary Engineering (PE), and Construction Engineering (CE), and Construction including contingency is $537,600. The project is funded by Federal Highways Administration (FHWA) in the amount of $476,589 and local funds through SB 1 $61,011. There are sufficient appropriations adopted in the FY 2021-22 Road Fund 002, Appropriation Unit PFP004 budget to finance the construction phase of the project.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The Project will repair the damaged sloped area by re-grading the slope, installing catch basin, 18-inch HDPE pipe and place a retaining wall (block wall) per State Standard Plans, including clearing and grubbing and traffic control.
