Receive the notice of adjustment of the annual salary of each member of the Board of Supervisors, in accordance with Section 2.04.370C of the County of Monterey Code consistent with the superior court judge salary adjustment of 0.3592%, effective July 1, 2019. The salary adjustments will be implemented July 7, 2023.

RECOMMENDATION:

Receive the notice of adjustment of the annual salary of each member of the Board of Supervisors, in accordance with Section 2.04.370C of the County of Monterey Code consistent with the superior court judge salary adjustment of 0.3592%, effective July 1, 2019. The salary adjustments will be implemented July 7, 2023.

 

SUMMARY/DISCUSSION:

Section 2.04.370C of the County of Monterey Code (Code) mandates that the annual salary of each member of the Board of Supervisors shall be adjusted by the percentage rate of adjustment applicable to the office of superior court judge.

 

A recent review of the Board of Supervisors salary identified there was an increase provided to the office of superior court judge for FY 2019-20, which was not implemented by the County. Attachment A is an April 8, 2020 memorandum from the Judicial Council of California and Exempt Pay Letter dated April 7, 2020, from the California Department of Human Resources (CalHR) detailing the salary increases provided to the office of superior court judge for FY 2019-20. In addition, Attachment B is an October 6, 2020 memorandum from the Judicial Council of California and Statutory Judicial Salaries letter dated October 2, 2020 from the CalHR indicating there were no salary increases for the office of superior court judge for FY 2020-21 as such, there was no salary change for the Board of Supervisors in FY 2020-21.

 

Under Section 2.04.370C, notice of any adjustment in compensation paid to members of the Board of Supervisors shall appear on the agenda of a regular meeting of the Board of Supervisors at least ten days prior to the date such adjustment is implemented; however, the effective date of such adjustment shall be the date any adjustment is effective for superior court judges. As such, this salary adjustment pursuant to the Code will be implemented July 7, 2023, with an effective date of July 1, 2019.

 

Please note that the adjustments provided in Section 2.04.0370C are automatic; action by the Board of Supervisors is not required or necessary for the adjustments to go into effect.

 

OTHER AGENCY INVOLVEMENT:

The County Administrative Office and Office of County Counsel concur with this report.

 

FINANCING:

The salary adjustment will result in estimated costs of approximately $3,187 for FY 2023-24. These salary adjustments were not included in the FY 2023-24 Adopted Budget. To the extent these salary increases cannot be absorbed within existing budget, staff will, as necessary, propose an adopted budget modification.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The notice of adjustment of the annual salary of the members of the Board of Supervisors is mandated by the Code and is not a part of the Board of Supervisors' Strategic Initiatives.
