a. Approve and authorize the Director of Health Services or designee to execute an Agreement with Society for the Prevention of Cruelty to Animals for Monterey County (SPCA) for the provision of all-inclusive spay/neuter mobile clinics for owned dogs and cats as well as feral cats of residents in South Monterey County in the amount of $42,000 with a term effective upon execution to June 30, 2025; and
b. Approve non-standard indemnification provisions as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to execute up to three future amendments to this Agreement where the amendments do not exceed 10% ($4,200) of the original Agreement amount, do not significantly change the scope of work, and the total Agreement amount does not exceed $46,200; and
d. Approve and authorize the Contracts and Purchasing Officer or their designee to execute future Amendments, provided they do not exceed an aggregate amount of $200,000 and fall within the signing authority of the Contracts and Purchasing Officer. (REVISED VIA SUPPLEMENTAL)

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute an Agreement with Society for the Prevention of Cruelty to Animals for Monterey County (SPCA) for the provision of all-inclusive spay/neuter mobile clinics for owned dogs and cats as well as feral cats of residents in South Monterey County in the amount of $42,000 with a term effective upon execution to June 30, 2025; and

c. SUMMARY/DISCUSSION:
The County of Monterey Health Department’s Animal Services Program (County) is responsible for providing animal control services in the unincorporated areas of Monterey County and City of Salinas (City) via the newly created Joint Powers Agreement (JPA). The County, through the JPA, also operates an Animal Services Center located at 160 Hitchcock Road, Salinas, California that offers an array of services, including but not limited to animal sheltering, field services, volunteers and outreach, and licensing services.
The County, City, and JPA continue to support the community by offering low cost spay/neuter opportunities for both feral cats and owned dogs and cats. Due to the high demand for these services, local veterinary clinics are currently unable to offer them. This is also magnified by a shortage in veterinary staff both in the county and statewide. Due to this continuous need, Animal Services is looking to further increase opportunities for affordable spay/neuter for pet owners. Animal Services will collaborate with the SPCA, a local organization that has the ability to provide mobile spay/neuter services within our communities, through a contractual partnership.
Through this Agreement, the SPCA will provide 10 Mobile Spay/Neuter clinics for both owned domestic dogs and cats as well as feral cats (as space allows). Each clinic will cost $4,200 and include spay/neuter, rabies and FVRCP or DHPP vaccination (and ear tip for any feral cats). These clinics are for any South County resident, residing in either an unincorporated Monterey County area or South County city that is located south of Chualar. These clinics look to spay/neuter approximately 250 animals in 5 months.
The Health Department recommends accepting the modification of the standard indemnification language to a mutual indemnification provision with the SPCA, a trusted local animal shelter, as it promotes equitable risk-sharing, strengthens the partnership with a long-standing community organization dedicated to animal welfare, and ensures the successful continuation of services that benefit the residents of the Monterey County.
This work supports the County of Monterey Health Department 2025-2028 Strategic Plan Goal(s): 1. Build Community Power and Partners’ Capacity to Increase Equity and Improve Health. It also supports the following of the ten essential public health services, specifically: 6. Enforce laws and regulations that protect health and ensure safety.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and the Auditor-Controller have reviewed and approved this Agreement as to legal form, and fiscal provisions, respectively. Risk Management has not approved the non-standard indemnity provisions.
FINANCING:
There will be no fiscal impact resulting from the approval of this action. Appropriations for this Agreement are included in the Health Department’s (183-4000-HEA001-8601) FY 2024-25 Adopted Budget.
