RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve Amendment No. 7 to Agreement No. A-12598 with Lionakis to continue to provide additional architectural design services for construction administration through construction for completion of the Jail Housing Addition Project, Project No. 8819, under Request for Qualifications No. 10401, to: increase the not to exceed amount by $225,000 for a total amount not to exceed $5,405,923 and to extend the expiration date from December 31, 2020 for six (6) additional months through June 30, 2021, for a revised term from November 18, 2013 to June 30, 2021; and

b.  Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 7 to Agreement No. A-12598 and any future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

 

SUMMARY/DISCUSSION:

Lionakis was selected for their professional qualifications and expertise in specialized detention projects necessary to provide architectural design services for construction administration through construction services (hereinafter, “services”) for the Jail Housing Addition Project, Project No. 8819 (hereinafter, “Project”) through a competitive selection process in accordance with County policies and State laws under Request for Qualifications (RFQ) No. 10401.

 

Amendment No. 7 will allow Lionakis to continue to provide architectural services for the Project including construction administration and additional services.  Amendment No. 7 will increase the total not to exceed amount of $5,180,923 by $225,000 for a total amount not to exceed $5,405,923 and extend the expiration date from December 31, 2020 for six (6) additional months through June 30, 2021, for a revised term from November 18, 2013 to June 30, 2021.  This extension provides services through the Jail Housing Project construction completion date of January 2021, with additional time through June 30, 2021 to allow for services during closeout.

 

Attachment A provides a summary of the Agreement to date and Attachment B provides a summary of the Agreement annual expenditures and balance.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and Auditor-Controller’s Office have reviewed and approved Amendment No. 7 as to form, and fiscal provisions, respectively. 

 

FINANCING:

The current Board of Supervisors approved Project budget is $90,508,822 which consists of $80,000,000 in State AB-900 Lease Revenue Bonds and a County match of $10,508,822.  Delays have pushed the Project over budget.  The current projected budget including costs covered in this Amendment No. 7 total $90,425,695.  On October 27, 2020, the Board of Supervisors approved $1,614,318 in Project funding from Building Improvement and Replacement Fund 478 to cover additional Project costs.  Additional information on the Project schedule and delay factors was presented to the Budget Committee on September 30, 2020 and the Board of Supervisors on October 27, 2020.  Sufficient appropriations to fund Amendment No. 7 are available in the Fiscal Year (FY) 2020-21 Adopted Budget for Fund 404, Unit 8174, Appropriations Unit RMA015. 

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The Agreement with Lionakis, as amended under Amendment No. 7, continues to recognize the exigent need for the services to construct a permanent solution for the Project.  The Project is needed to provide a larger facility as the high occupancy count makes it critical, and additionally to assist the County with the State-mandated milestones.  The recommended action supports the BOS’ Strategic Initiatives as indicated below:
