RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Authorize the County Purchasing Agent or designee, to execute an amendment to the standard Agreement with Sicuro Data Analytics, Inc. for Statistical Analysis, retroactive to February 1, 2026 through December 31, 2027, increasing the maximum contract amount from $150,000 to $371,100, an increase of $221,100;
b. Accept standard contract provisions as recommended by the District Attorney;
c. Authorize the County Purchasing Agent or designee and the District Attorney or their designee to sign and execute the appropriate documents and verifications when required;
d. Authorize the County Purchasing Agent or designee to issue purchase orders on an as-needed basis pursuant to this Amended Agreement, retroactive to February 1, 2026 through December 31, 2027.
SUMMARY:
On May 5, 2023, the Board approved an Agreement with Sicuro Data Analytics, LLC for statistical analysis services in the amount of $150,000, Agreement No. A-16262. Approval is requested to amend the non-standard Agreement with Sicuro Data Analytics, Inc. to continue existing data collection services and add new analytical services required to support compliance with the Racial Justice Act and Assembly Bill 1071, effective January 1, 2026. This amendment extends the term of the Agreement retroactive to February 1, 2026, through December 31, 2027, and increases the maximum contract amount from $150,000 to $371,100, an increase of $221,100.
DISCUSSION:
On May 5, 2023, the Board approved a non-standard Agreement with Sicuro Data Analytics, LLC for statistical analysis services in the amount of $150,000, Agreement No. A-16262. Sicuro Data Analytics brings expertise in causal data analytics, supported by specialized institutional knowledge of the County of Monterey criminal justice system. These services have supported the District Attorney’s Office by reviewing and validating case management system data and addressing missing or incomplete information to support compliance with the Racial Justice Act.
Since approval of the original Agreement, legislative developments related to criminal justice data have occurred. Assembly Bill 1071, effective January 1, 2026, builds upon the Racial Justice Act and continues to require a broad range of relevant discovery that may be subject to disclosure in criminal proceedings.
While the initial services established a complete analytical data set, the proposed agreement will provide ongoing data updates to help maintain data accuracy, as well as expert analytical support, including analytical requests, expert witness services, and consultation, on an as-needed basis.
This proposed amendment extends the Agreement retroactive to February 1, 2026 through December 31, 2027, and increases the maximum contract amount from $150,000 to $371,100, an increase of $221,100, to support ongoing data-related efforts of the Monterey County District Attorney’s Office.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
County Counsel has approved the agreement as to legal form. The Auditor-Controller has approved as to fiscal provisions.
FINANCING:
The Fiscal Year 2025-26 Adopted Budget for the District Attorney, Appropriation Unit DIS001, Unit 8063 includes sufficient appropriations for this amendment. Funding for this Agreement for Fiscal Year 2025-2026 is provided through State Community Corrections Partnership (CCP) funds and was included in the District Attorney’s Recommended Budget. Ongoing costs will be included in the budget approval process. There will be no increase in the General Fund Contribution resulting from this Board action.
