Title
Adopt resolutions approving property tax transfers for the proposed annexation of property to the Cypress Fire Protection District and the Carmel Highlands Fire Protection District respectively.

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt resolutions approving the fair share distribution property tax transfer for proposed annexations of property to the Cypress Fire Protection District and the Carmel Highlands Fire Protection District respectively.
 
SUMMARY:
The Local Agency Formation Commission (LAFCO) of Monterey County is in receipt of two annexation proposals involving annexation of property to the Cypress Fire Protection District and the Carmel Highlands Fire Protection District.  The proposals cannot be considered by LAFCO until the Board of Supervisors adopts resolutions accepting the exchange of property tax revenues.
 
DISCUSSION:
The Board of Supervisors has adopted a property tax transfer formula which allows for fire protection districts to be allocated a portion of the County's property tax increment.  The formula has been revised to reflect the County's loss of property tax revenue that was imposed by the State during fiscal year 1993-94.  Non-affected jurisdictions retain their percentage share of property taxes collected within an affected tax rate area.  
 
The proposed annexations to the Cypress Fire Protection District include all 2,611 acres within the District's existing Sphere of Influence broken down by the following areas: Jacks Peak (Area 1), Swim Ranch (Area 2), Hatton Canyon Area (Area 3), Carmel River Lagoon/Rancho Canada Area (Area 4), Olmstead Road Area (Area 5) and Quail Meadows Area (Area 6).
 
The proposed annexations to the Carmel Highlands Fire Protection District include all 1,975 acres within the District's existing Sphere of Influence broken down by the following areas: Point Lobos Ranch Area (Area 1), Carmel Meadows Area (Area 2) and Point Lobos State Natural Reserve Area (Area 3).
 
LAFCO of Monterey County has provided maps showing the proposed annexation areas as well as legal notices which include the Assessor's Parcel Numbers for all parcels to be annexed. Both the maps and the LAFCO legal notices are attached to this report for reference. In both cases, the stated purpose of the annexations is to provide fire protection, emergency medical response, rescue, hazardous material response, fire prevention and public education to the affected areas.
 
OTHER AGENCY INVOLVEMENT:
The Cypress Fire Protection District and the Carmel Highlands Fire Protection District both concur with the requested action. The Auditor-Controller's Office was consulted in the preparation of this report.  The attached resolution was approved as to form by County Counsel.  
 
FINANCING:
The annexation proposal territory is located within various tax rate areas. The following shows property tax increment which would flow to the Fire Protection Districts upon annexation:
