a. Approve and authorize the Director of the Information Technology Department to sign an extension of a lease with the State of California, for its use of rack and tower space in a County communication shelter, extending the term to include July 1, 2015 through June 30, 2020; and
b. Authorize the Director of the Information Technology Department to sign up to five (5) renewals to the lease, of one year each, on the same terms or on terms that are substantially similar to the current lease.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Information Technology Department to sign an extension of a lease with the State of California, for its use of rack and tower space in a County communication shelter, extending the term to include July 1, 2015 through June 30, 2020; and
b. Authorize the Director of the Information Technology Department to sign up to five (5) renewals to the lease, of one year each, on the same terms or on terms that are substantially similar to the current lease.
SUMMARY/DISCUSSION:
The Information Technology Department (ITD) oversees several shelters that house radio and other communications equipment throughout Monterey County. Public safety and other agencies seek to lease space in these shelters to house their communications equipment and to further their communications operations.
The State of California, Department of General Services, for the benefit of the Department of Fish and Wildlife (DFW), has leased space from the County of Monterey for the purpose of housing its communications equipment at the County’s Mount Toro facility since 2010. The original term of this communications vault lease was from July 1, 2010 through June 30, 2015.
As permitted by the original lease, the State of California, DFW, has indicated that it seeks to extend the lease for five (5) additional years. Thus, an extension of the lease term to include July 1, 2015, through June 30, 2020, is submitted for the Board’s consideration. The extension also clarifies the manner in which rent will be adjusted annually so that the County is able to recoup the full cost of making the rack and tower space available as those costs rise. The rate charged to the State of California, DFW, for fiscal year 2015-2016 is $3,344.32.
ITD further recommends that the Board authorize the Director of the Information Technology Department to execute five (5) additional renewals of this lease, of one year each, through June 30, 2025, on the same or substantially similar terms to the current lease.
OTHER AGENCY INVOLVEMENT:
County Counsel and Risk have reviewed and approved the lease extension as to form.
FINANCING:
The approval of this lease extension will allow ITD to continue to be able to bill and accept payment for this site. Approval of this lease extension will have no impact on the general fund as the cost of providing rack space and communications services is offset by rent paid.
