a. b. Approve a Cooperative Agreement with Caltrans for the replacement of the traffic signals on State Route 1 at Carmel Valley Road; and

c. Authorize the Resource Management Agency Director to execute the Cooperative Agreement in the amount of $275,000.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

 

a.                     Certify that on February 23, 2017, the appropriate authority of the County of Monterey considered the environmental effects of the project and adopted the Mitigation Monitoring and Reporting Program as shown in the Mitigated Negative Declaration adopted by Caltrans in April 2012 and in the Addendum adopted by Caltrans in February 2017;

 

b.                     Approve a Cooperative Agreement with Caltrans for the replacement of the traffic signals on State Route 1 at Carmel Valley Road; and

 

c.                     Authorize the Resource Management Agency Director to execute the Cooperative Agreement in the amount of $275,000.

 

SUMMARY:

Approval of the agreement between the State Department of Transportation (Caltrans) and the County of Monterey (County) will allow the Resource Management Agency (RMA) to replace traffic signals on State Route 1 at the Carmel Valley Road intersection and receive reimbursement from Caltrans from the State Highway Operations and Protection Program (SHOPP) Minor Funds.  Work includes replacement of wooden traffic poles with steel and replacement of signal lights.

 

DISCUSSION:

The Cooperative Agreement establishes the roles and responsibility of the County and Caltrans for the reconstruction of the traffic signal on State Route 1 at Carmel Valley Road intersection.  The work will upgrade the wooden signal poles to meet current State Standards and will be done as part of the State Route 1 Climbing Lane project.  The County will administer the construction contract and oversee the construction of the overall project.  Once complete, Caltrans will accept and maintain the improvement.

 

The State Route 1 Climbing Lane project work consists, in general, of constructing a second northbound through lane (climbing lane) on the east side of State Route 1 between Rio Road and Carmel Valley Road.  The project was advertised in September to solicit construction bids.  RMA will return to the Board of Supervisors in November 2017 to award the construction project.

 

In compliance with the California Environmental Quality Act (CEQA), Caltrans and the County, working together, prepared a Mitigated Negative Declaration (MND) and an addendum to the MND.  Caltrans adopted the MND in April 2012 and the addendum in February 2017.  On February 23, 2017, the Zoning Administrator of the County of Monterey considered the MND and addendum, and adopted the Mitigation Monitoring and Reporting Program (MMRP). 

 

Since Caltrans’ adoption of the MND in April 2012, Caltrans’ adoption of the addendum in February 2017, and the County of Monterey’s consideration of the MND and addendum and adoption of the MMRP on February 23, 2017, no substantial changes due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects are proposed in the project which will require major revisions of the previous MND and addendum adopted by Caltrans.  (CEQA Guidelines Section 15162 Subsequent Negative Declarations; CEQA Guidelines Section 15096 (f) Process for a Responsible Agency).

 

Further, no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the MND and addendum were adopted by Caltrans or considered by the County of Monterey shows that: 1) the project will have one or more significant effects not discussed in the MND and addendum adopted by Caltrans; 2) significant effects previously examined will be substantially more severe than shown in the previous MND and addendum adopted by Caltrans; 3) mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measures or alternative; or 4) mitigation measures or alternatives which are considerably different than those analyzed in the previous MND would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative.  Therefore, no subsequent MND or addendum is required.  (CEQA Guidelines Section 15162 Subsequent Negative Declarations; CEQA Guidelines Section 15096 (f) Process for a Responsible Agency).

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed and approved the Agreement as to form.

 

FINANCING:

The Cooperative Agreement states that Caltrans would pay the County $275,000 for the reconstruction of the traffic signal.

 

The total estimated project cost, including engineering, environmental, right-of-way and construction is $5,824,814.  Funding from a variety of State (including this Cooperative Agreement) and local revenue in the amount of $5,824,814 has been authorized for design, environmental, right-of-way and construction for the Project.  Local revenue is comprised of Regional Surface Transportation Program (RSTP) in the amount of $2,090,319 and development fees in the amount of $209,494.  The estimated cost for FY 2017-18 for construction management and construction contract is $4,547,501.  There are sufficient appropriations adopted in the FY 2017-18 Road Fund 002, Appropriation Unit RMA012 budget to finance the construction phase of the project.  The project is expected to be completed in FY 2017-18.
