a. Approve and authorize the Director of Health or Assistant Director of Health to execute a new three (3) year Mental Health Services Agreement between the County of Monterey and Benjamin Macasaet DBA New Horizon II Adult Residential Facility in Salinas, CA for the provision of mental health services for Monterey County adult residents with severe psychiatric disabilities in the amount of $148,920 for Fiscal Year (FY) 2022-23, $148,920 for FY 2023-24, and $148,920 for FY 2024-25, for a maximum County obligation of $446,760 for the retroactive term of July 1, 2022 through June 30, 2025; and
b. Approve non-standard insurance provision in Agreement as recommended by the Director of Health; and
c. Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($44,676) of the original Agreement amount and do not significantly alter the scope of services.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health or Assistant Director of Health to execute a new three (3) year Mental Health Services Agreement between the County of Monterey and Benjamin Macasaet DBA New Horizon II Adult Residential Facility in Salinas, CA for the provision of mental health services for Monterey County adult residents with severe psychiatric disabilities in the amount of $148,920 for Fiscal Year (FY) 2022-23, $148,920 for FY 2023-24, and $148,920 for FY 2024-25, for a maximum County obligation of $446,760 for the retroactive term of July 1, 2022 through June 30, 2025; and
b. Approve non-standard insurance provision in Agreement as recommended by the Director of Health; and

SUMMARY/DISCUSSION:
The County has maintained Agreement A-14363 with Benjamin Macasaet DBA New Horizon II Adult Residential Facility, which expired on June 30, 2022. New Horizon II Adult Residential Facility (ARF) is a licensed Community Care Facility authorized by the State Department of Social Services, as defined in Section 1502 of the Health and Safety code. The New Horizon II ARF provides community-based activities that create a normalizing experience for adults with severe psychiatric disabilities, which benefit persons determined to be most in need of help, particularly those recently discharged from psychiatric locked facilities. These structured activities provided by New Horizon successfully assist its residents to reintegrate into the community.
This retroactive New Horizon II renewal Agreement continues the provisions of the expiring Agreement an additional three-years, through FY 2024-25, allowing for a daily maximum accommodation of twenty-four (24) beds for Monterey County clients requiring access to this level of care at a new $17.00 per client per day patch rate. That updated patch rate was established for the companion New Horizon I facility in November 2021, to accommodate a substantial increase in Insurance premiums for both facilities. These daily supplemental rates at the New Horizon facilities are a highly cost-effective alternative to higher cost facilities outside of the County.
The approval of this Agreement provides for the continuity of mental health services to adults with severe psychiatric disabilities and complies with the requirements of the Welfare and Institutions Code Section 5600 (Bronzan-McCorquodale Act).
This Agreement contains a non-standard insurance provision of claims-based coverage. This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.
This agreement is late in being presented to your board and is retroactive to July 1, 2022 due to a confluence of events, including processing of other renewing agreements, delays in correct insurance being provided to the County by the vendor as required by County Risk Management, and contract department approvals being delayed by vacations.
This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Goal: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services. It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.
OTHER AGENCY INVOLVEMENT:
The office of the County Counsel, Risk Management, and Auditor-Controller have reviewed and approved this Agreement as to legal form, non-standard Insurance provisions, and fiscal provisions, respectively.
FINANCING:
This Agreement is 100% funded by 1991 Realignment revenues. The funds for this Agreement ($148,920) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2022-23 Adopted Budget. The funds for this Agreement for FY 2023-24 ($148,920) and FY 2024-25 ($148,920) will be included in the respective Health Department’s Behavioral Health (HEA012, Unit 8410) FY 2023-24 and FY 2024-25 Requested Budgets.
