those members present, the Board of Supervisors hereby:
Continued Public Hearing from January 11, 2011 at 1:30 p.m. to March 15, 2011, at
10:30 a.m. to consider Petitioner/Freeholder initiated Petition to vacate/abandon a 0.74
mile segment of an unimproved County Road commonly known as Old Stage Road and
variously known in the past as Los Angeles Stage Road, Monterey/Los Angeles Road,
Old El Camino Real, Bee Rock Road or Old County Road in the Bradley area of South
Monterey County and continued consideration of fee waiver request.

SUBJECT: Continued Public Hearing
Consider further continuance to March 15, 2011, of the public hearing on a
Petitioner/Freeholder initiated Petition to vacate/abandon a 0.74 mile segment
of an unimproved County Road commonly known as Old Stage Road, and
variously known in the past as Los Angeles Stage Road, Monterey/Los Angeles
Road, Old El Camino Real, Bee Rock Road or Old County Road in the Bradley
area of South Monterey County, and Petitioner/Freeholder fee waiver request.

RECOMMENDATION:
It is recommended that the Board of Supervisors continue to March 15, 2011, the Public Hearing
to consider Petitioner/Freeholder initiated Petition to vacate/abandon a 0.74 mile segment of an
unimproved County Road commonly known as Old Stage Road, and variously known in the past
as Los Angeles Stage Road, Monterey/Los Angeles Road, Old El Camino Real, Bee Rock Road
or Old County Road in the Bradley area of South Monterey County, and Petitioner/Freeholder
fee waiver request.
SUMMARY/DISCUSSION:
The Petitioner/Freeholder initiated Petition proposes to abandon a 0.74 mile segment of the
unimproved Old Stage Road pursuant to the request by twenty Freeholders in petitions to the
Board of Supervisors dated September 18, 2009 and September 28, 2007. The County right-of-
way begins at Nacimiento Lake Drive traversing southeasterly through three properties, running
roughly parallel and south of an existing Army Tank Road ending at the San Luis Obispo County
line. This road does not serve the general traveling public and is not on the County's current list
of maintained roads. Pursuant to California Streets and Highways Code Section 8321, the Board
is authorized to consider the Petitioner/Freeholder initiated Petition. A location map is attached.
This matter was previously set for hearing on December 14, 2010, but continued to allow two of
the principles in the matter, Mr. Wendell Gutter and Dr. David Henry, to engage in further
discussions towards a resolution of certain property issues that may affect how the County acts.
The County is informed that the parties are close to a settlement, but there is not yet agreement
on all terms. Therefore, staff is recommending a further continuance of the matter, to allow for
the conclusion of those negotiations, until March 15, 2011.

None.
FINANCING:
There is no impact to the General Fund or the Road Fund.
