a. Approve and accept the Law Enforcement Agency Agreement template to be used with local law enforcement agencies to provide Sexual Assault Response Team services to individual cases of suspected adult, adolescent, and pediatric sexual assault and domestic violence in Monterey County, through June 30, 2031 with funds received by the County varying based on services provided;
b. Accept non-standard insurance and mutual indemnification provisions as recommended by the Director of Health Services;
c. Approve and authorize future updates to the Law Enforcement Agency Agreement template through June 30, 2031 with funds received by the County varying based on services provided, in accordance with local, state, and federal law, subject to review and approval of County Counsel;
d. Approve and authorize execution by the Director of Health Services or designee of the Law Enforcement Agency Agreement template with local Law Enforcement Agencies for Fiscal Year (FY) 2026-2027 through FY 2030-2031 with funds received by the County varying based on services provided, subject to review and approval of County Counsel; and
e. Approve and authorize future amendments to Law Enforcement Agency Agreements, through June 30, 2031 with funds received by the County varying based on services provided, that do not significantly change the level of risk or the scope of a party’s obligations or responsibilities, subject to review and approval of County Counsel.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and accept the Law Enforcement Agency Agreement template to be used with local law enforcement agencies to provide Sexual Assault Response Team services to individual cases of suspected adult, adolescent, and pediatric sexual assault and domestic violence in Monterey County, through June 30, 2031 with funds received by the County varying based on services provided;

SUMMARY:
The County of Monterey Health Department (MCHD) has operated the Sexual Assault Response Team (SART) Program since July 1, 2007. SART includes trained health professionals who perform forensic examination and treatment of adults, adolescents and children that are suspected to have been the victims of sexual assault and domestic violence. SART examiners are called upon by local law enforcement agencies to recover forensic evidence based on these examinations and provide testimony during court proceedings.
DISCUSSION:
The SART Program Coordinator works with County of Monterey District Attorney’s Office and Sheriff’s Office, and contracts with California State University Monterey Bay Campus Police Department and local law enforcement agencies in 12 cities, including Carmel-By-The-Sea, Del Rey Oaks, Gonzales, Greenfield, King City, Marina, Monterey, Pacific Grove, Salinas, Sand City, Seaside and Soledad. Local law enforcement agencies are required to provide annual contribution and will be charged for each examination performed.
This work supports the County of Monterey Health Department 2025-2028 Strategic Plan Goals: 1. Build community power and partners’ capacity to increase equity and improve health; and 2. Provide exceptional person-centered care through accessible, community-focused health service. This work reflects three of the essential Public Health services: 1. Investigate, diagnose, and address health problems and hazards affecting the population; 2. Communicate effectively to inform and educate people about health, factors that influence it, and how to improve it; and 3. Strengthen, support, and mobilize communities and partnerships to improve health.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Office of the County Counsel and Auditor- Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.
FINANCING:
There is no cost to the County associated with this request. If approved, this will authorize the Department to use the updated Agreement template with law enforcement agencies for the provision of SART services.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
These Agreements align with the Board of Supervisors Strategic Plan Goals of Well-Being and Quality of Life and Safe and Resilient Communities. Services provided by the SART Program ensure that the emotional, medical, and judicial needs of victims of sexual assault and domestic violence are met in a timely and trauma informed fashion, contributing to the well-being of patients who receive Sexual Assault Forensic Examinations (SAFEs). In addition, the accurate collection and documentation of evidence assist local law enforcement agencies and the District Attorney’s office in their attempts to investigate and prosecute crimes, contributing to safer communities.
