Adopt a resolution to:

RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a resolution to:

a.  Approve and authorize the Chair of the Board of Supervisors to sign an Agreement with the King City Young Farmers, a nonprofit public benefit corporation created under the laws of the State of California, to develop and maintain the Avenue of Honor Memorial within a one (1) acre area at San Lorenzo Regional Park, King City, effective September 22, 2020;

b.  Approve non-standard Agreement language waiving the requirement of workers’ compensation insurance as all work will be performed by volunteers; and

c.  Permit the Young Farmers to hold a dedication ceremony for the “Avenue of Honor” Memorial on November 11, 2020, at 11 a.m., and waive all entry fees for this dedication.

SUMMARY/DISCUSSION:

On July 28, 2020, the Board approved an area within San Lorenzo Regional Park to locate the new Avenue of Honor Memorial and made a finding that the project is categorically exempt from CEQA pursuant to CEQA Guidelines Section 15301.  Staff was directed to work with the Young Farmers to develop an Agreement to install and maintain improvements within the approved area.  The proposed Agreement to develop and maintain the one-acre Avenue of Honor Memorial is provided as Attachment B for Board consideration.  The site where the memorial will be located is depicted in Exhibit A of the Agreement; the proposed site plan and associated improvements are delineated in Exhibit B.  The Board approved the name “Avenue of Honor” for the main entry road into San Lorenzo Park as part of the original project.  The Chair of the Board of Supervisors authorized staff to bring this matter directly to the full Board.

 

Approval of the proposed Agreement will allow the Young Farmers to install, maintain, and replace, as needed, site improvements for the Avenue of Honor Memorial commemorating South County Military personnel killed in action in foreign wars.  The community-build project under the County’s Volunteer Program will be staffed by willing volunteers donating their time to install the improvements that were planned, designed, developed, and funded by the Young Farmers.  Accordingly, it is recommended that the standard requirement of workers’ compensation insurance be waived as volunteers will perform all work.  In its place during the course of work, the Young Farmers shall maintain a General Liability Insurance PolicyAdditionally, the location of the approved site lends itself to future expansion as a memorial facility; therefore, staff recommends that the number of plaques allowed not be limited as in the former Agreement.

 

The improvement plans for the memorial site consist of:

                     An accessible 10-foot-wide pathway from existing parking lot to memorial area

                     Sitting Benches to be placed along the pathway

                     One (1) entrance sign, 4-foot high by 6-foot wide, placed by the pathway

                     Granite Memorial Plaques (affixed to 4-foot-high standards)

                     One (1) Donor Recognition Sign (located in the southeast corner of project area)

                     Three stones each 4-foot wide; outside left and right stones 5-foot high, and center stone 6-foot high.  The stones will include black granite plaques (3-foot wide by 4-foot high).

                     One (1) Battlefield Cross Statue

                     Flagpoles with flags representing the five branches of the military, the U.S. and California State flags, and the Prisoner-of-War flag.

 

The Board is asked to approve and authorize the Chair of the Board to sign the Agreement with Young Farmers to develop and maintain the Avenue of Honor Memorial at San Lorenzo Regional Park; approve the non-standard agreement language waiving the requirement of workers’ compensation insurance as all work will be performed by volunteers; and approve and permit the activity and waive all related fees (e.g., facility use, guest entry).

 

OTHER AGENCY INVOLVEMENT:

RMA-Parks staff is working primarily with Young Farmers and Veterans of Foreign Wars (VFW) on the planning, design, and development of the Avenue of Honor Memorial.  County Counsel reviewed and approved the proposed Agreement between Monterey County and Young Farmers as to form; Risk Management reviewed and approved the required insurance clause for the Agreement.  Monterey County Agricultural Rural Life Museum (MCARLM) was consulted regarding the proposal.  If approved by the Board, Staff will continue to work with the Young Farmers and community volunteers on the project and assist with the dedication ceremony on November 11, 2020.

 

FINANCING:

The initial estimated replacement cost for the project, $12,500, was completely funded by outside parties consisting of a $500 contribution from an anonymous donor; $6,000 from Young Farmers; and $6,000 from the Monterey County Parks Foundation, a separate, non-profit entity.  Staff understands that the Young Farmers will fully fund remaining project costs to relocate the plaques and all costs associated with the installation, repair, restoration, replacement, and ongoing maintenance above and beyond typical maintenance provided by RMA-Parks staff.  Accordingly, no use of County General Funds is anticipated.  RMA-Parks is providing in-kind staff support for the design, development, and final placement of the memorial plaques and will assist with the dedication ceremony planned for November 11, 2020, if the Board approves and permits the activity and waives all entry fees (estimated at $500). Prioritization of this in-kind support may impact RMA-Parks availability of resources to address existing responsibilities.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This recommendation supports the Board of Supervisors’ Administration and Infrastructure Strategic Initiatives.  Fostering a spirit of cooperation with the local community by working with a non-profit organization to provide this Avenue of Honor memorial reflects well on local government as well as promotes the County Park facility by providing an additional educational attraction that will bring visitors to the park while enhancing pride in the local community by honoring its members that offered the greatest sacrifice in service to their country.
