Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 3 between the County of Monterey and Teleosoft Inc., for maintenance and support services for the Civil Records Management System, extending the term by two years to June 30, 2026, for a new not to exceed amount of $644,611.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 3 between the County of Monterey and Teleosoft Inc., for maintenance and support services for the Civil Records Management System, extending the term by two years to June 30, 2026, for a new not to exceed amount of $644,611.

 

SUMMARY/DISCUSSION:

The Board of Supervisors previously approved a five (5) year agreement with Teleosoft for the purchase of software for the Civil Division, on February 9, 2016. 

 

The Civil Division of the Monterey County Sheriff’s Office performs the processing and serving of civil procedures (utilizing the software purchased above) including small claims judgments, earning withholding orders, real property levies and bank levies, and evictions. All these services are provided throughout the County including locations inside the incorporated cities.

 

AB 2791 which is effective January 2024, requires that the Sheriff’s Office accept electronic signatures and payments for court documents. The existing vendor, Teleosoft, has a relationship with Authorize.net and currently accepts credit card and digital signatures. After consulting with the Information Technology Division, it was determined that the only way to allow for electronic signature and payments online, would require the MCSO to utilize the Cloud, which would ensure that the County Network remained secure.

 

Amendment No. 2 added funding for the ability to e-sign and Amendment No. 3 would provide a cloud solution.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel has reviewed and advised on this Agreement as to legal form. The Auditor-Controller has reviewed and approved the Agreement as to fiscal provisions.  The County Information Technology Department has reviewed the technical components and approves this amendment.

 

FINANCING:

All available ongoing revenues have been allocated. The Sheriff’s Office, as directed by the Board of Supervisors in July 2023, will be returning to the budget committee to provide a budget status update at the December 12, 2023, budget committee meeting.  Implementation of this agreement by the County for the Civil Section is crucial in meeting AB 2791 and Government Code Section 26666.
