a. Approve and authorize the Contracts/Purchasing Officer, or her designee, to sign a retroactive Agreement with Monterey Bay Veterans, Inc. to provide ADA accessible shuttle service during major events at WeatherTech Raceway Laguna Seca retroactive from July 1, 2021 through December 31, 2021, for an amount not to exceed $10,000; and
b. Approve and authorize the Contracts/Purchasing Officer, or her designee, to execute up to three (3) future amendments to this Agreement where the total amendments do not exceed 10% ($1,000) of the agreement amount and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer, or her designee, to sign a retroactive Agreement with Monterey Bay Veterans, Inc. to provide ADA accessible shuttle service during major events at WeatherTech Raceway Laguna Seca retroactive from July 1, 2021 through December 31, 2021, for an amount not to exceed $10,000; and
b. Approve and authorize the Contracts/Purchasing Officer, or her designee, to execute up to three (3) future amendments to this Agreement where the total amendments do not exceed 10% ($1,000) of the agreement amount and do not significantly change the scope of work.
SUMMARY/DISCUSSION:
A&D Narigi Consulting, LLC (A&D) requests retroactive approval of an Agreement with Monterey Bay Veterans, Inc. to provide ADA accessible shuttle service during major events at WeatherTech Raceway Laguna Seca. Monterey Bay Veterans, Inc. provide golf cart shuttles as well as the drivers to operate them. A&D believes this service is essential to the overall success of the events.
A&D states they are requesting retroactive approval of the agreement because they were unaware that a separate agreement was needed in addition to the Volunteer Service Agreement executed by the many other volunteer organizations with A&D Narigi Consulting.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel has reviewed and approved the Agreement as to form.
FINANCING:
LSRA fund 453 is currently running with a negative cash balance and expenditures are trending higher than revenue. If this trend continues the fund will need to reduce expenditures, increase revenue or seek a General Fund subsidy. The Management firm has submitted budgets indicating that a positive net income is expected and continues to advise that they will manage to positive end of year results. Approval of contracts increasing expenditures may add to the deficit if the Management firm is not successful in generating a positive operating income in Fiscal Year 2022.
