a. Approve a non-standard, retroactive agreement and authorize the County Administrative Officer, or designee, to sign an Agreement with Bottling Group, LLC accepting PepsiCo as Official Soft Drink and Bottled Water partner at WeatherTech Raceway Laguna Seca effective January 1, 2021 through December 31, 2025; and
b. Approve and authorize the County Administrative Officer, or designee, to execute up to two (2) future amendments to this Agreement where the total amendments do not exceed 10% of the remaining agreement amount and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve a non-standard, retroactive agreement and authorize the County Administrative Officer, or designee, to sign an Agreement with Bottling Group, LLC accepting PepsiCo as Official Soft Drink and Bottled Water partner at WeatherTech Raceway Laguna Seca effective January 1, 2021 through December 31, 2025; and
b. Approve and authorize the County Administrative Officer, or designee, to execute up to two (2) future amendments to this Agreement where the total amendments do not exceed 10% of the remaining agreement amount and do not significantly change the scope of work.
SUMMARY/DISCUSSION:
Pepsi has been the Official Partner with WeatherTech Raceway Laguna Seca (WRLS) since 2010. For the designation as Official Soft Drink and Bottled Water partner at WRLS, Bottling Group, LLC agrees to provide annual support funds in the amount of $10,000 per year for the five (5) years of the Agreement and will receive sponsor benefits as outlined on Exhibit B of the Agreement.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel cannot approve non-standard provisions.
FINANCING:
The agreement with Bottling Group, LLC will be funded through Fund 453 Laguna Seca Budget Unit 8536. Funding for the Agreement is included in the FY 2020-2021 Approved Budget and the FY 2021-2022 Recommended Budget. Approval of the recommended action will have no additional impact on the County General Fund.
