RECOMMENDATION:
 
It is recommended that the Board of Supervisors approve and authorize the Contracts/Purchasing Officer to sign Amendment #3 to the contract with Liebert Cassidy Whitmore (LCW) for labor relations consulting and negotiations from July 1, 2012 - September 30, 2013 increasing the amount from $100,000.00 to $250,000.00.
 
SUMMARY/DISCUSSION:
 
The initial contract was for the term of April 1, 2012 through June 30, 2012 with no fixed dollar amount.  This contract was initially for units D (Public Defenders) and E (District Attorneys).  In July 2012, it was determined that negotiations with units D & E were going to take longer than originally estimated.  In addition, the County was entering labor negotiations with bargaining unit S (Registered Nurses) and it was determined that assistance was needed.  Amendment #1 extended the term of the contract with LCW through December 31, 2012 and setting a maximum of $100,000.00.  In December 2012 units D and E were finalized, but unit S was still in progress; therefore, Amendment #2 was executed extending the term of the contract through September 20, 2013 with no increase in the dollar amount.  In consideration that the County has sixteen (16) labor contracts expiring June 30, 2013, with only one Senior Personnel Analyst assigned to labor relations, outside assistance in the form of consulting and assistance at the negotiation tables will be critical to completing all Memoranda of Understanding in a timely fashion.  In the FY 2012-13 budget, monies were approved in the County Administrative Office (CAO) budget to cover outside consulting expenses for assistance in labor relations during FY2012-13 in the amount of $120,000.  As the County prepares for negotiations with the sixteen (16) units that will open in March 2013, it is projected that an additional $150,000 will be required for all upcoming negotiations.
LCW will work with current County staff to achieve the labor relations objectives set forth by the Board of Supervisors.

FINANCING:
HR will work with Budget and Fiscal Analysis staff to fund this necessary contract amendment.  If monies are not found within the FY2012-13 approved budget for Human Resources, then a recommendation will be brought forth to the Board at a later date.
