RECOMMENDATION:
It is recommended that the Board of Supervisors
a) Receive a report on the status of Code Enforcement Case #CE080396. Property the Red
Barn) is located on Hwy 101, in Aromas and is owned by Fran Ellingwood.
SUMMARY/DISCUSSION:
Case History:
The Red Barn, flea market sales, has expanded its outdoor sales area beyond the approvals of the
permitted area. Various other violations have been cited and the property owner has been
notified by Compliance Order. Some, but not all, of the violations cited on the Compliance
Order issued on December 8, 2009 are as follows: Construction, electrical and plumbing work
done without the required permits, repair of bridges required, fire sprinklers required for the floor
area of the Red Barn structure, various structures in need of repair of construction, electrical and
plumbing systems, lack of adequate flush toilets with proper water and sewer connections,
storage and parking of unregistered inoperable vehicles, petroleum-contaminated soil, permanent
occupancy of a recreational vehicle without required plumbing or electrical permits for
connections.
The Compliance Order required a compliance date of January 7, 2010. Some of the corrective
actions indicated on the Compliance Order were satisfied, however, many were not and the
owner does not agree with all requirements mandated by the County.
Current Status of Case:
This case was most recently set for a case management hearing to be held on December 10,
2010. Several days before that date, the court called and notified staff that the case was
continued to February 25, 2011. The Court will consider the types of evidence that will be
considered at the trial and on what date the trial is to be held.
OTHER AGENCY INVOLVEMENT:
The Monterey County Health Department and Environmental Health Division is assisting with
water and sewer concerns in various areas involving this property.
The Sheriff Department has observed numerous un-licensed vehicles stored on a hill which are
being used to store contents of flea market booths.
The Aromas Fire Department is assisting in fire safety concerns.
