Approve Amendment No. 5 to Professional Services Agreement No. A-11906 with TRC Engineers, Inc. to include additional design, engineering, plans, specifications, estimate, right-of-way and utility coordination services and other assistance tasks for Phase 2, Final Design Basic Tasks, of the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197), Project No. 862265, Federal Aid Project No. HP21L-5944 (097) (formerly Federal Aid Project No. STPLHSR-5944 (058), in the amount of $74,297 for a total amount not to exceed $1,039,088, and extend the term through December 31, 2017; and
b. Authorize the Contracts/Purchasing Officer or the Contracts/Purchasing Supervisor to execute Amendment No. 5 to Professional Services Agreement No. A-11906 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 5 to Professional Services Agreement No. A-11906 with TRC Engineers, Inc. to include additional design, engineering, plans, specifications, estimate, right-of-way and utility coordination services and other assistance tasks for Phase 2, Final Design Basic Tasks, of the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197), Project No. 862265, Federal Aid Project No. HP21L-5944 (097) (formerly Federal Aid Project No. STPLHSR-5944 (058), in the amount of $74,297 for a total amount not to exceed $1,039,088, and extend the term through December 31, 2017; and

SUMMARY:
Amendment No. 5 to Professional Service Agreement (PSA) No. A-11906 with TRC Engineers for the Castroville Bicycle/Pedestrian Path and Railroad Crossing project is necessary to complete final design. Attached is a list of amendments to the PSA to date.
DISCUSSION:
The project is to provide a convenient and safe railroad crossing for bicyclists and pedestrians, especially school-aged children attending Elkhorn Elementary School and North Monterey County High School, keeping them off of the Union Pacific Railroad (UPRR) track and State Route 156. Currently, pedestrians and bicyclists are unlawfully crossing the UPRR track. The proposed Project would provide convenient, safe and legal access to, and continuity, with an existing Class I bicycle and pedestrian path that commences at Castroville Boulevard. School-aged children can then continue onto North Monterey High School and Elkhorn Elementary School from Castroville.
The proposed bicycle/pedestrian path with bridge will have an 8 foot paved width for the path and a 12 foot width for the bicycle/pedestrian bridge over the UPRR. The bridge will be a concrete box girder bridge with eleven spans at a total length of 1,170 feet. The proposed bridge will be 24 feet above the UPRR tracks. From recent utility underground investigation, it was discovered and determined that AT&T underground fiber optic lines are in conflict with abutment no. 1 and approach structure of the proposed bicycle/pedestrian bridge. Amendment No. 5 will allow TRC Engineers to redesign portion of the bridge and address the conflict.
Currently the project design is 90% complete and right-of-way phase of the project is 50% complete. The project is anticipated to be in construction July 2016.
Amendment No. 5 will increase the PSA by $74,297, for a total not to exceed amount of $1,039,088; and extend the term from December 28, 2015 to December 31, 2017.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller’s Office have reviewed and approved Amendment No. 5 as to form and legality, and fiscal provisions, respectively.
FINANCING:
There is no impact to the General Fund. The estimated total cost of the Project, including engineering, environmental, right-of-way and construction, is $9,264,143. Funding from a variety of Federal, State and local sources have been authorized for completion of the Project. Sufficient funds are available in the RMA - Public Works Road Fund (Fund 002, Department 3000, Unit 8195, Appropriation Unit RMA012) to finance Amendment No. 5.
