RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and authorize the Director of Health or designee to sign a Memorandum of Agreement ("Agreement") with the United States Army Garrison-Presidio of Monterey ("PoM") for administrative and related services for the Sexual Assault Response Team, effective upon date of execution by County, for a five year term; and
b.      Authorize the Director of Health or designee to approve three future amendments up to ten percent (10%) of the annual amount, which does not significantly alter the scope of services.
 
SUMMARY/DISCUSSION:
The Sexual Assault Response Team (SART) has been in operation in Monterey County since 1998.  The Monterey County Health Department (MCHD) has operated the SART program since July 1, 2007.  SART includes highly trained health professionals who perform forensic examination and treatment of individuals, both adults and children, who are suspected to have been the victims of sexual assault.  These examiners are called upon to recover evidence based on these examinations and to provide testimony during court proceedings.  Local law enforcement agencies contract with MCHD provide these services.
 
Currently, MCHD contracts with over 15 law enforcement agencies throughout Monterey County.  MCHD is requesting the Board of Supervisors (BOS) to approve this Agreement with PoM in order to provide SART related services for the Army and Presidio of Monterey and to accept the non-standard language and mutual indemnification.  
 
This work supports the MCHD 2011-2015 Strategic Plan Initiative, 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one or more of the ten essential public health services, specifically: 2) Diagnose and investigate health problems and health hazards in the community; 6) Enforce laws and regulations that protect health and ensure safety; 7) Link people to needed personal health series and assure the provision of health care when otherwise unavailable.
 
OTHER AGENCY INVOLVEMENT:
County Counsel and the Auditor-Controller have reviewed this Agreement as to legal form and fiscal provisions respectively.  County Counsel recommended seeking BOS approval due to non-standard language.  This Agreement is on file with the Clerk to the Board.
 
FINANCING:
This Agreement is funded by examination fees paid by PoM.
