Adopt a Resolution:

b. Authorizing and directing the CAO, RMA Director and the Sheriff to take such other and further actions as may be necessary or appropriate to meet the State's requirements for the award of the AB 900 Phase II funding.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors adopt a Resolution:
 
a. Authorizing the expenditure of $4,032,778 from the Capital Projects Fund 404, Unit 8174 Appropriation Unit RMA015, as matching funds for the conditional AB 900 Phase II award of $36,295,000 from the State of California for the Jail Expansion project; and
b. Authorizing and directing the CAO, RMA Director and the Sheriff to take such other and further actions as may be necessary or appropriate to meet the State's requirements for the award of the AB 900 Phase II funding.
 
SUMMARY/DISCUSSION:
On December 6, 2011, the Board of Supervisors approved Resolution No. 11-377 authorizing Sheriff Scott K. Miller to sign and submit an application for a local adult detention facility AB 900 construction grant in the amount of $80 million, and making other necessary and appropriate findings and declarations supporting the AB 900 construction grant application.  The application was submitted and found worthy of funding at the Corrections Standards Authority (CSA) Board Meeting on March 8, 2012.  The CSA had $200 million in funds available for conditional awards to medium sized counties.  The total requested amount for projects considered worthy of funding was in excess of $400 million.  Monterey County was ranked fourth with the first three ranked counties conditional awards totaling in excess of $220 million, leaving Monterey County with no award.
 
Between March and end of the fiscal year, the State reallocated unused funds from Phase I conditional awards into Phase II medium size counties allowing for the third ranked county to be fully funded and a partial funding for Monterey County.  On July 1, 2012, the name of the CSA was changed to the Board of State and Community Corrections (BSCC).
 
On July 26, 2012, the BSCC voted to approve the conditional award of $36,295,000 toward a $40,327,778 expansion of the County of Monterey Adult Jail.  At a special meeting on August 9, 2012, the Board of Supervisors accepted the conditional award and directed that staff submit a revised project scope and return for the authority to expend the required matching funds.  In early August, the County submitted an Amended Application to the BSCC, consistent with the new conditional award, to revise the project scope.  The BSCC will, at their September Board meeting, confirm the project scope changes per the County's amended application.  Today's action will authorize the expenditure of $4,032,778 from the Capital Projects Fund 404 for the required matching funds (this amount has been revised upward from $3,629,500 reported to the Board at the August 9 meeting to accurately reflect the matching amount).
 
The BSCC acceptance of the County's Amended Application with revised scope will trigger a series of specific milestones activities the County will need to comply with to maintain the conditional award.  The Board previously authorized the RMA Director to contract with consultants to commence professional services for an environmental document, due diligence, public outreach, and design, and that authority will allow the County to comply with the milestone dates set by the State.
 
OTHER AGENCY INVOLVEMENT:
RMA-Public Works, the Office of the County Counsel, Sheriffs Office, and Board of State and Community Corrections are in concurrence with the recommended action.  This item will be brought to both the Capital Improvement Committee and the Budget Committee at their next meeting.
 
FINANCING:
The environmental review, public outreach, due diligence and design would be funded from the $4,032,778 matching funds.  The recommended funding source for the matching funds would be from the Capital Projects Fund 404, Unit 8174 Appropriation Unit RMA015.  There are sufficient funds available in Fund 404 to fund the County's match.  The RMA will be following up in a separate Board Report with a Recommended Multi-Year Funding Plan for Fund 404 that will include this commitment.
