RECOMMENDATION:

It is recommended that the Board of Supervisors: 

a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Standard Agreement Involving Hazardous Materials between Remediation Risk Management, Inc. dba Triton Construction and the County of Monterey for testing, maintenance, and repair of underground fuel storage tanks located at WeatherTech® Raceway at Laguna Seca with a term beginning November 18, 2021, through November 30, 2024, for an amount not to exceed $50,000; and

b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to two (2) future amendments to this Agreement where the total amendments do not exceed 10% ($5,000) of the Agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

 

SUMMARY/DISCUSSION:

The County Administrative Office Fleet Management Division (Fleet) is responsible for hazardous waste management at County refueling facilities, which includes underground and aboveground fuel storage tanks.  On November 18, 2021, Fleet was notified by Monterey County Health Department-Environmental Health Bureau that the 91 octane (Premium gasoline) tank and underground dispenser containment (UDC) at Laguna Seca Recreation Area required repair.  Although Fleet does not manage the fuel purchases/sales for the tanks at Laguna Seca, Fleet engaged Remediation Risk Management Inc., dba Triton Construction (Triton), who had previously provided services to Monterey County, to request permits and complete the necessary repairs immediately due to health and safety issues.

 

PWFP requests the Board of Supervisors approve and authorize the Monterey County Laguna Seca Representative to execute the proposed retroactive Standard Agreement Involving Hazardous Materials with Triton (Attachment A) and up to two (2) future amendments to the Agreement where the total amendments do not exceed ten percent (10%), or $5,000, of the Agreement amount and do not significantly change the scope of work.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed retroactive Agreement as to form and fiscal provisions, respectively.  Risk Management reviewed and approved the insurance coverage and limits.

 

FINANCING:

The cost of the contract services provided by Triton is not to exceed $50,000 for the duration of the Agreement.  There is sufficient funding in Laguna Seca Recreation Area Fund 453, Appropriation Unit CAO046, to cover the increased fees in this Agreement in Fiscal Year 2021-22.  Future cost for services for the remainder of this Agreement will be included in the respective fiscal year recommended budget in Fund 453, under its new Appropriation Unit PFP067.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors Strategic Initiatives for Administration, Infrastructure, and Public Safety.  Prompt action by PWFP to effect timely repairs protects the County Park facility and appurtenances and the local environment from potential hazardous contaminants, promotes the safety of park visitors and Parks personnel, and ensures the continuity of County operations in full compliance with State and County regulations.
