Title

a. Accept and approve the revised County of Monterey Mental Health Services Agreement template (“standard template agreement”), containing County of Monterey’s standard risk provisions of insurance and indemnification, for the provision of mental health treatment services with psychiatric impairments and disabilities by County Mental Health Plan providers;

b. Approve and authorize the Director of Health or Assistant Director of Health to execute the standard template agreement with each of the County Mental Health Plan providers listed in Attachment B (individually), effective for the terms set forth in Attachment B, not to exceed the individual contract amounts as set for in Attachment B, for a total in the aggregate not to exceed $57,701,877;

c. Approve and authorize the Director of Health or Assistant Director of Health to execute a standard template agreement with additional providers for mental health treatment and related services, during FY 2023-24, where the contract amount for each agreement with each additional provider does not exceed $200,000 and where the aggregate for all contracts with additional providers does not exceed $2,000,000, subject to approval by County Counsel, County Risk Manager, and County Auditor-Controller; and

d. Approve and authorize the Director of Health or Assistant Director of Health to execute up to three future amendments to each agreement with the providers listed in Attachments B that in total, does not exceed 10% of the initial contract amount specified in each agreement, and that does not significantly change the scope of services, for a total in the aggregate not to exceed $65,472,064.

RECOMMENDATION:

It is recommended that the County of Monterey Board of Supervisors:

a. Accept and approve the revised County of Monterey Mental Health Services Agreement template (“standard template agreement”), containing County of Monterey’s standard risk provisions of insurance and indemnification, for the provision of mental health treatment services with psychiatric impairments and disabilities by County Mental Health Plan providers;

b. Approve and authorize the Director of Health or Assistant Director of Health to execute the standard template agreement with each of the County Mental Health Plan providers listed in Attachment B (individually), effective for the terms set forth in Attachment B, not to exceed the individual contract amounts as set for in Attachment B, for a total in the aggregate not to exceed $57,701,877;

c. SUMMARY/DISCUSSION:

The County of Monterey Health Department, Behavioral Health Bureau, currently utilizes a Board-approved Mental Health Services Agreement (Agreement) template to contract with providers for the provision of mental health and supportive services to eligible Medi-Cal beneficiaries of Monterey County.

 

Behavioral Health seeks Board approval of a revised and updated Agreement template drafted in accordance with the requirements for contract payment reimbursement and cost and revenue reporting of the California Advancing and Innovating Medi-Cal (CalAIM) program, a multi-year California Department of Health Care Services (DHCS) initiative to improve the quality of life and health outcomes of our population by implementing broad delivery system, program, and payment reform across the Medi-Cal program.  The key changes to the Agreement incorporate CalAIM provisions in access to services, mental health program integrity, and practice guidelines. The CalAIM initiative is based on the success of the prior federal waiver programs, which includes but are not limited to, Whole Person Care Pilot (WPC). Throughout this new DHCS initiative, services provided under programs such as WPC were transitioned to CalAIM.

 

Behavioral Health has submitted this comprehensive board report to enhance contracting efficiency by allowing the Director of Health or Assistant Director of Health to execute agreements for specialty mental health and supportive services without having to request separate Board approval for each agreement. Behavioral Health seeks to enter into new agreements with contractors that historically have provided quality services to County residents for many years. The providers listed in Attachment B have agreed to the County’s standard boilerplate insurance and indemnification provisions.  The Department will continue to secure Board approval for amendments to any agreements that significantly change the scope of services and in total exceed 10% of the original agreement amount.

 

This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Goals: 1. Empower the Community to Improve Health; 2. Enhance Public Health and Safety through Prevention; 3. Ensure Access to Culturally and Linguistically Appropriate, Customer-Friendly, Quality Health Services; and 4. Engage MCHD Workforce and Improve Operational Functions to Meet Current and Developing Population Health Needs.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel, Risk Management, and Auditor-Controller have reviewed and approved the revised County of Monterey Mental Health Services Agreement template (“standard template agreement”) as to legal form and fiscal provisions, respectively, and are supportive of this request to authorize the Director of Health or Assistant Director of Health to execute agreements with identified providers in Attachments B and others meeting County standard agreement requirements. 

 

FINANCING:

There is no impact on the General Fund from this action.  As appropriate, the revenue and appropriations for items on Attachment B have been included in the Health Department’s FY 2023-24 (HEA012, Unit 8410) Adopted Budget.
