AN ORDINANCE OF THE COUNTY OF MONTEREY, STATE OF CALIFORNIA,
AMENDING SECTION 2.76.050 OF THE MONTEREY COUNTY CODE RELATING
TO DETERMINATION AND PAYMENT OF ESTIMATED FEES FOR
SUPPLEMENTAL LAW ENFORCEMENT SERVICES.
County Counsel Summary
This ordinance amends the County Code to enlarge from twenty-four 24)
hours to fifteen 15) working days the required notice period within which an
applicant must pay the estimated fee for requested supplemental law enforcement
services and vehicles to the County through the Sheriff
The Board of Supervisors of the County of Monterey ordains as follows:
SECTION 1. Section 2.76.050 of the Monterey County Code is amended to read as
follows:
2.76.050 Determination and payment of estimated fee.
A. All supplemental law enforcement services provided shall be reimbursed to the
County at their actual cost, as determined by the County's Auditor-Controller.
B. At least fifteen 15) working days before the time when the supplemental law
enforcement services are to be provided, the applicant shall pay to the County of Monterey
through the Sheriff the estimated fee for such supplemental law enforcement services at the
rate(s) set by resolution of the Board of Supervisors from time to time.
C. At least fifteen 15) working days before the time when the supplemental law
enforcement services are to be provided, the applicant shall pay to the County of Monterey
through the Sheriff the estimated fee for such use of Sheriffs vehicles as shall be set by
resolution of the Board of Supervisors. Within ten 10) working days after the event, the Sheriff
shall send an adjusted final bill for the supplemental law enforcement services actually provided
to the responsible individual or organization.

SUBJECT: Consider and adopt an Ordinance of the County of Monterey amending the
Monterey County Code, Section 2.76.050 relating to determination and payment
of estimated fees for supplemental law enforcement services.

RECOMMENDATION:
It is recommended that the Board of Supervisors consider and adopt an Ordinance of the County
of Monterey amending the Monterey County Code, Section 2.76.050 relating to determination
and payment of estimated fees for supplemental law enforcement services.
SUMMARY/DISCUSSION:
Section 2.76.050 of the Monterey County Code currently provides that applicants for
supplemental law enforcement services shall pay to the County through the Sheriff the estimated
fee for such services at least twenty-four 24) hours before the time when the services are to be
provided and that the applicants pay the estimated fee for the use of the Sheriffs vehicles at least
twenty-four 24) hours before the time the services are to be provided. This short required notice
period before the supplemental services are to be provided creates a hardship on the Sheriff s
Office, both financially and in its personnel assignments. Enlarging the required notice period
and payment for the use of the Sheriff's vehicles to fifteen 15) working days before the time
when the supplemental services are to be provided will enable the Sheriffs Office to secure the
necessary funding from the applicant in a timely manner and will allow the Sheriffs Office to
handle the assignment of Sheriffs personnel in the most efficient way possible. On July 7, 2009,
the Board introduced the Ordinance and waived first reading.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed the Ordinance and has approved it.
FINANCING:
There is no County cost associated with this proposed Ordinance.

supplemental law enforcement services.
