a. Approve and authorize the Director of the Information Technology Department to execute a non-standard Agreement between Harris Corporation and the County of Monterey to provide Technical Assistance Center “TAC” support for the County Next Generation Radio System (NGEN) in the annual amount of $3l,610, and a total amount of $158,050 for the 5-year term of July 1, 2018 to June 30, 2023;
b. Approve non-standard agreement terms as recommended by the Director of the Information Technology Department; and
c. Approve and authorize the Director of the Information Technology Department to execute up to three (3) amendments to the Agreement, extending the term by one (1) year each, subject to County Counsel approval, provided the terms of the Agreement remain substantially the same and provided the amount per extension does not increase by more than 10% of the original annual cost ($3,161 maximum additional cost per extension).

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Information Technology Department to execute a non-standard Agreement between Harris Corporation and the County of Monterey to provide Technical Assistance Center “TAC” support for the County Next Generation Radio System (NGEN) in the annual amount of $3l,610, and a total amount of $158,050 for the 5-year term of July 1, 2018 to June 30, 2023;

SUMMARY:
The Information Technology Department (ITD) has provided significant support for the Next Generation Radio System (NGEN) project, which involves upgrading the County’s radio communication towers throughout Monterey County. The proposed agreement will provide technical assistance for resolving problems with site equipment, mobile and portable end-user terminal equipment on a 24-hour per day, seven days a week, 365-days a year basis. The agreement will cover all Harris provided radio transmission equipment associated with the NGEN analog and digital systems.
DISCUSSION:
The County selected Harris Corporation as the primary vendor to implement the NGEN project, which replaces existing public safety and local government voice and data radio networks, as required by Federal Communications Commission mandate.
In support of this installation, ITD requires immediate access to Harris technical support on an as-needed basis to ensure operational availability of critical public safety communications systems.
This agreement will apply to both analog and digital radio transmission equipment that comprise the NGEN system, which provides mission critical communications to law, fire, and ambulance response personnel in addition to local government, state and federal mutual aid response.
OTHER AGENCY INVOLVEMENT:
County Counsel does not approve the following non-standard provisions: absence of vendor defense and indemnification of County; limitations on vendor’s warranty obligations to County; limitations on the amount of and type of damages available to County in the event of vendor breach; non-standard termination provisions; interpretation of agreement under Virginia, not California law; and vendor’s unilateral right to increase costs upon specified notice to County.
FINANCING:
The funds for payment of the costs of this Agreement have been included in the FY 18-19 Approved Budget for the Information Technology, ITD 1930, Unit 8436 Appropriations Unit INF002.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The services provided pursuant to this agreement will enable ITD to provide the County with a 24-hour technical assistance as needed on critical County radio transmission equipment.
