a. RECOMMENDATION:

It is recommended the Board of Supervisors:

 

a.                     Authorize the Deputy Purchasing Agent for Natividad Medical Center (NMC) or his designee to execute an Agreement for Health Information Exchange Services (“Service Agreement”) with Central Coast Health Connect LLC (“CCHC”), for a total maximum liability of $545,619.36 for the period of July 1, 2016 through June 30, 2018;

b.                     Authorize the Deputy Purchasing Agent for NMC or his designee to execute a Health Information Exchange Hospital Participation Agreement (Monterey County Hospital Participants) (“Participation Agreement”) with CCHC, for a term commencing on its Effective Date and coterminous with that of the Service Agreement;

c.                     Authorize the Deputy Purchasing Agent for NMC or his designee to execute up to the three (3) future amendments to the Service Agreement, which do not significantly alter the scope of work and which, in the aggregate, do not cause an increase of more than ten percent (10%) ($54,561.94) of the original cost of the Service Agreement; and

d.                     Authorize the Deputy Purchasing Agent for NMC or his designee to execute up to the three (3) future amendments to the Participation Agreement, which do not significantly alter the scope of work.

 

SUMMARY/DISCUSSION:

 

Natividad Medical Center seeks approval of two Agreements: 1) a proposed Health Information Exchange Hospital Participation Agreement, allowing NMC to become a participant of Central Coast Health Connect, LLC (CCHC), Monterey County’s regional Health Information Organization (HIO); and 2) a proposed Agreement for Health Information Exchange Services, pursuant to which CCHC shall perform health information exchange services related to the County’s participation in the HIO. 

CCHC was created to oversee and facilitate a Health Information Exchange (HIE), which will mobilize healthcare information electronically across organizations within the Monterey County community. As a result of the Participation Agreement, NMC will join Community Hospital of Monterey Peninsula (CHOMP) and Salinas Valley Memorial Hospital (SVMH) as the three core Monterey County hospital participants in the HIO.

CCHC’s founding members are Community Health Innovations, LLC (CHI) and SVMH. CCHC is managed by a Board of Managers. CCHC has contracted with CHI to perform day-to-day management of CCHC.

The purpose and benefit to Monterey County residents to becoming a hospital participant of CCHC is that the exchange of health information electronic data can improve quality, safety, efficiency, reduce health disparities, lead to improved engagement of patients and families and improve care coordination, population and public health and improve communication between hospitals, clinics and care providers all the while maintaining privacy and security of patient health information.

 

CCHC Participation Agreement

The CCHC Participation Agreement serves as the agreement for participation between CCHC and the County of Monterey/NMC. The Participation Agreement sets forth the terms of participation of the County. The Participation Agreement includes CCHC insurance requirements; general liability, errors and omissions and cyber liability and indemnification language.

The Terms & Conditions are included and establish the conditions under which the County will provide data and access data through CCHC’s health information exchange.

CCHC Privacy and Security Policies and Procedures are included and govern how CCHC will safeguard patient information and ensure compliance with patient privacy laws.  These policies were developed with the participation of the Information Technology and Compliance staff and outside experts of NMC, CHOMP, SVMH and CHI.

 

Agreement for Health Information Exchange Services

The Agreement for Health Information Exchange Services between CCHC and the County sets forth the County’s annual maximum liability to CCHC for Fiscal Year 2016/17 in the amount of $270,670.68 and Fiscal Year 2017/18 $274,948.68 for a total of $545,619.46 for the term of the Agreement.  The Agreement includes the scope of services, payment provisions and billing procedures based on the County standard template.

Moving forward, CCHC is now in the process of executing Provider Participation Agreements between CHOMP and SVMH associated physicians and practices with expected data affiliation by June 2016. Provided NMC’s Participation and Services Agreements are approved by the Board of Supervisors, NMC ‘s goal is affiliate and begin sharing data with the other participants August 1, 2016. CHOMP, NMC and SVMH have been additionally been working with their collaborating clinic practices in preparation for their data affiliation. In the case of NMC, this includes the Monterey County Health Department (MCHD) and it is anticipated that MCHD’s data affiliation will begin shortly after that of NMC.

 

OTHER AGENCY INVOLVEMENT:

 

County Counsel has reviewed and approved this Agreement as to legal form and risk provisions. The Auditor-Controller has reviewed and approved this Agreement as to fiscal provisions. The Agreement has also been reviewed and approved by NMC’s Finance Committee on April 28, 2016 and by its Board of Trustees on May 6, 2016.

 

FINANCING:

 

The total cost for this Agreement is not to exceed $545,619.46, of which $270,670.68 is included in the Fiscal Year 2016/17 Recommended Budget. Funding for Fiscal Year 2017/18 will be included in the budget as appropriate. There is no impact to the General Fund.
