RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a non-standard Professional Agreement with Jennifer Yu, M.D., to provide physical medicine and rehabilitation services to medically fragile children, upon execution to June 30, 2031 with no exchange of funds;
b. Approve non-standard indemnification and insurance provisions as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to sign up to three future amendments that do not significantly change the scope and do not add funds to the agreement.
SUMMARY:
The California Children’s Services Medical Therapy Program (MTP) provides physical and occupational therapy to children with qualifying physical disabilities at three clinics in Monterey County, aiming to help each child reach their maximum physical potential. Care is guided by a multidisciplinary team, led by a Medical Therapy Conference (MTC) physician who oversees therapy plans, equipment needs, referrals, and overall medical management. The program relies on physicians with specialized expertise, selected from a California Department of Health Care Services (DHCS) pre-approved list. The Department is seeking approval for an agreement with Jennifer Yu, M.D., to provide these services, with DHCS compensating her for her work.
DISCUSSION:
The Health Department, Public Health Bureau, CCS MTP provides physical therapy (PT) and occupational therapy (OT) services to eligible children with physically handicapping conditions at three clinic locations in Monterey County. The goal of the MTP is to assist each child to obtain their maximum physical potential through the provision of physical and occupational therapy services. Fundamental to the provision of services for children with physical handicapping conditions is the concept that the nature of the disability, with its effect on physical growth, personality development, and the learning process, requires the combined professional services of physicians, OT, PT, educational, nursing, nutrition and social work disciplines.
It is the function of the Medical Therapy Conference (MTC) to bring together the expertise of this multi-disciplinary team in to achieve maximum benefit for the child and family. The MTC physician provides the oversight, management and coordination of the child’s PT and OT services, as well as durable medical equipment (DME) and bracing/splinting needs. The MTC physician is the team leader and makes the final determination of the child’s medical therapy plan of care. Specific responsibilities include review of the child’s medical and therapy history, confirmation of MTP eligible condition through examination and documentation of clinical findings, development of prescriptions, identification of need for specialty referrals, and communication with care providers. The physician’s goal is to assure the medical therapy plan provides the child with appropriate medical intervention to allow the child the opportunity to reach maximum physical function. The CCS MTP utilizes physicians of various specialties (orthopedics, physical medicine & rehabilitation, pediatrics, etc.) with expertise in managing these challenging conditions.
The Department seeks approval for an Agreement with Jennifer Yu, M.D., for physical medicine and rehabilitation physician services to support the MTC and continue specialized PT and OT services to these medically fragile children. The CCS MTP utilizes physicians selected from a California Department of Health Care Services (DHCS) pre-approved list of providers. DHCS compensates MTC physicians for their services. When an MTC physician provides care to CCS patients in the MTU, the physician is providing services on behalf of the County to CCS MTU eligible patients, not as an agent of their primary employer. Accordingly, the County would provide malpractice coverage for the services Dr. Yu provides for the MTC in Monterey County.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Offices of the County Counsel and Auditor-Controller have reviewed and approved this agreement as to legal form and fiscal provisions, respectively.

FINANCING:
There is no exchange of funds between parties associated with the Agreement. The County’s cost for professional liability insurance coverage is funded 100% with Health Realignment. There are sufficient appropriations in the Health Department’s (001-4000-8124-HEA003) FY 2025-26 Adopted budget.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
This Agreement supports the County of Monterey Strategic Plan Goal A: Well-Being and Quality of Life. The Agreement improves the quality of services to the community provided in the CCS Medical Therapy Program, thereby improving the quality of life of the children served in the program. This is done by providing physician consultation in the MTC in the child’s local community. The multi-disciplinary team in the MTC works together to ensure the child’s rehabilitation and overall well-being needs are addressed, making referrals to appropriate specialists and community agencies to support the child and family.
