Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve Amendment No. 1 to Professional Services Agreement No. A-15439, Multi-Year Agreement #3200*5857, with Moffatt & Nichol, a California Corporation, to provide on-call bridge design services for various bridge projects located in Monterey County, Request for Qualifications (RFQ) #10783, to extend the expiration date for one additional year through July 12, 2025 for a revised term of July 13, 2021 to July 12, 2025, with the option to extend the term for one additional 1-year period, and increase the not to exceed maximum by $500,000 to a total amount of $1,250,000; and

b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 1 to Professional Services Agreement No. A-15439 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

 

SUMMARY:

The Department of Public Works, Facilities and Parks (PWFP) has established several on-call Professional Services Agreements (PSAs) for specialized services when County staff requires special expertise or when the volume of work exceeds staff’s capacity to manage in a timely manner.  PWFP and other County Departments utilize their own on-call PSAs for specialized expertise in operations, management and specific facility and capital projects.

 

The recommended actions would allow for the approval of Amendment No. 1 (Attachment A) to PSA No. 15439 with Moffatt & Nichol, a California Corporation (Moffatt & Nichol) to: update the provisions of the PSA, extend the expiration date, and increase the not to exceed amount to allow for continued on-call bridge design services.

 

DISCUSSION:

In 2021, Moffatt & Nichol was one of five consultants selected for their expertise and capabilities necessary to provide on-call bridge design services for various bridge projects located in Monterey County under a competitive selection process in accordance with County policies and State and Federal laws under Request for Qualifications (RFQ) #10783.  PWFP has identified a need to increase the not to exceed amount of the PSA with Moffatt & Nichol and recommends that the County of Monterey Board of Supervisors approve the proposed Amendment No. 1 to continue to allow on-call bridge design services for a variety of County bridge projects.  These projects comprise of a wide range of scopes from new bridges to minor and major alterations to existing bridges.  The on-call PSA will augment the need for services when the volume of work exceeds PWFP’s capacity, and to provide professional specialized expertise that PWFP does not have.     

 

Amendment No. 1 will update the provisions of the PSA, extend the expiration date for one additional year through July 12, 2025, for a revised term of July 13, 2021 to July 12, 2025, with the option to extend the term for one additional 1-year period, and increase the not to exceed amount of $750,000 by $500,000 for a total amount not to exceed $1,250,000.

 

Attachments B and C, provided for reference, include PSA No. A-15439 and a summary of the PSA and annual expenditures and balance of the PSA to date.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel, the Office of the County Counsel-Risk Management, and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively.

 

FINANCING:

Costs for services provided by Moffatt & Nichol will be reimbursed from the respective funding source for each project and funding will be contained within the approved budget allocations of the individual departments authorizing use of the on-call PSA.  For PWFP, funding is either within the approved budget allocations for a specific operating unit or contained within the Board of Supervisors approved project budget within Fund 002 Road Fund.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiatives by allowing for the planning and development of sustainable, physical infrastructure that improves the quality of life for County residents and supports economic development results, and further provides for adequate County facilities and infrastructure.
