RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Chair to sign Amendment No. 1 to the Professional Services Agreement with MNS Engineers, Inc. in an amount not to exceed $165,092, for a total contract amount not to exceed $401,512, to provide final payment for continued construction management and inspection services for completion of the Hyland Drive/El Rancho Way Street Improvement Project in the community of Boronda.
SUMMARY:
The recommended action will permit final reimbursement for continued consulting construction management and inspection services to support completion of the Hyland Drive/El Rancho Way Street Improvement Project. It was originally anticipated the construction contract would be completed in six months. However, it took the construction contractor longer to complete the project than originally anticipated, and the project required ten months to complete. It was therefore necessary for the construction management consultant to continue to provide the needed services during this extended time, and to increase payment to the consultant for that work. The construction project was completed April 5, 2012, and on May 1, 2012 the Board of Supervisors approved the Notice of Completion.
DISCUSSION:
After completion of a competitive solicitation process, on November 9, 2010 the County Board of Supervisors approved a Professional Services Agreement with MNS Engineers, Inc. to provide consulting construction management and inspection services for the Hyland Drive/El Rancho Way Street Improvement Project in the community of Boronda.
As construction proceeded, it took the construction contractor longer to complete the project than originally anticipated, primarily due unanticipated work required to match the existing front yard and driveway improvements in the project neighborhood and to coordinate with property owners who "fronted" the street. It was therefore necessary for the construction management consultant to continue to provide the needed services to complete the project, and to increase payment to the consultant for that work.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approved the recommended Amendment No. 1 as to form. The Department of Public Works actively participated in the management of the construction of the project, and concurs in the amount and scope of services contained in the recommended Amendment. On April 26, 2012, the Oversight Board of the Successor Agency approved a request by the Successor Agency to enter into a new Funding Agreement with the County to provide funding to cover final project costs.
FINANCING:
The recommended action will have no impact on the General Fund and the Road Fund. The cost to the County for the services provided under the recommended Amendment No. 1 will be funded pursuant to the Funding Agreement between the County and the Successor Agency to the Redevelopment Agency scheduled for consideration at this meeting.
Sufficient funds for implementation of the recommended action are contained in the budget of the Boronda Redevelopment Successor Agency (Fund 172, Unit 8209).
