Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Chief Information Officer to retroactively execute a fourth amendment to the existing non-standard Wireless Communication Site Lease Agreement with Crown Castle MU LLC in the amount of $552,681 to operate a county communications facility, extending the agreement for an additional five (5) years from June 1, 2023, through May 31, 2028; and

b. Accept non-standard provisions as recommended by the Chief Information Officer; and

c. Authorize the Chief Information Officer to sign up to three (3) future amendments to this Agreement, extending each term by five (5) years each, with a 4% increase per extension, overall Agreement aggregate Not to Exceed amount to $1,502,141 even if no additional Agreements are entered into.  

 

SUMMARY:

The Bryant Canyon communication site is a location that provides radio and dispatching communication for South County first responders and County departments. The County has had the use of this site owned by Crown Castle MU LLC since 2008.  The approval of this agreement will allow the County to continue to provide emergency communication services in South County.

 

DISCUSSION:

The existing Wireless Communications Site Lease Agreement with Crown Castle MU LLC for a County communications facility at the Bryant Canyon site was approved by the County Board of Supervisors on June 24, 2008, authorizing three (3) additional five-year terms, which extended the Agreement through May 31, 2023.

 

The radio communications equipment installed at this site provides radio communications coverage and connectivity for the County Emergency Communications Department and public safety agencies in south Monterey County. In addition, the microwave equipment at this site provides access to the County's telecommunications network and enables the County to maintain a redundant data network at a reduced cost. The proximity of the Bryant Canyon radio communications site continues to be key in providing coverage in this region of the County.

 

Approval of Amendment number 4 retroactively extends the Agreement for a term date of June 1, 2023, through May 31, 2028.

 

The Chief Information Officer recommends this non-standard Wireless Communication Site Lease Agreement to provide crucial communication coverage to South County at the Bryant Canyon site.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed this non-standard Wireless Communication Site Lease Agreement and has approved as to form.  Auditor-Controller’s Office reviewed the contract but does not agree to the non-standard payment provisions.

 

FINANCING:

Funds required for FY 22-23 have been included in the FY 22-23 budget.  The funds have been included in the FY 23-24 Recommended Budget for the Information Technology Department, ITD 1930, Appropriations Unit INF002.  Transactions relating to future fiscal years will be included in each respective Recommended Budget based on the anticipated utilization of the services.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The use of the Bryant Canyon communications site is crucial to the emergency communications and other County department communication systems in south county.
