a. Approve Amendment No. 3 to Professional Services Agreement MYA#3000*270 with Bender Rosenthal, Inc. to continue to provide on-call real estate services (RFQ #10249), in the amount of $100,000 for a total amount not to exceed $200,000, and extend the term to January 31, 2016, with the option to extend the Agreement for one (1) additional one (1) year period, in accordance with the terms and conditions of the Agreement;
b. Approve Amendment No. 2 to Professional Services Agreement MYA#3000*269 with Universal Field Services, Inc. to continue to provide on-call real estate services (RFQ #10249), in the amount of $100,000 for a total amount not to exceed $200,000, and extend the term to January 31, 2016, with the option to extend the Agreement for one (1) additional one (1) year period, in accordance with the terms and conditions of the Agreement; and
c. Authorize the Contracts/Purchasing Officer to execute the Amendments to the Professional Services Agreements and future amendments to these Agreements where the amendments do not significantly alter the scope of work or change the approved Agreement amounts.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to Professional Services Agreement MYA#3000*270 with Bender Rosenthal, Inc. to continue to provide on-call real estate services (RFQ #10249), in the amount of $100,000 for a total amount not to exceed $200,000, and extend the term to January 31, 2016, with the option to extend the Agreement for one (1) additional one (1) year period, in accordance with the terms and conditions of the Agreement;

SUMMARYDISCUSSION:
On July 16, 2010, RMA - Public Works issued Request for Qualifications (RFQ) #10249 for the purpose of providing its various divisions with a prequalified list of real estate professionals to complete a variety of projects related to roadways, bridges and facilities. RFQ #10249 provided for an initial term of two years, with the option to extend for three additional one year periods, for a total of five years. On February 1, 2012, Professional Services Agreements were entered into with Bender Rosenthal, Inc., and Universal Field Services, Inc. for on-call real estate services. RMA - Public Works has identified a need for Bender Rosenthal, Inc. and Universal Field Services, Inc. to continue to provide on-call real estate services, mainly for projects related to road right-of-way acquisitions and land appraisals. Amendment No. 3 to the Professional Service Agreement (PSA) with Bender Rosenthal, Inc. and Amendment No. 2 to the PSA with Universal Field Services, Inc. will increase each PSA by $100,000 for a total amount not to exceed $200,000 for each PSA and extend the term of each PSA from January 31, 2015 to January 31, 2016, in each PSA. OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 3 and Amendment No. 2 to the PSAs as to form and legality, and fiscal provisions, respectively
FINANCING:
There is no impact to the General Fund. Services provided by Bender Rosenthal, Inc., and Universal Field Services, Inc., will be reimbursed from the prospective funding source from each project.
