Adopt a Resolution of Proclamation of a Local Emergency, dated December 1, 2019, in accordance with California Government Code Section 8630 et. al., due to atmospheric river event beginning November 27, and which is expected to continue through December 4, 2019 - proclaimed December 1, 2019 - concerning the Carmel River and Carmel River Lagoon, potentially causing damage to public infrastructure and private property, thereby causing conditions of extreme peril to the safety of persons and property nearby.  (4/5ths vote required)

RECOMMENDATION:

 

a.                     Adopt a Resolution of Proclamation of a Local Emergency, dated December 1, 2019, in accordance with California Government Code Section 8630 et. al., due to atmospheric river event during the period November 27 through December 1, 2019, concerning the Carmel River and Carmel River Lagoon, potentially causing damage to public infrastructure and private property, thereby causing conditions of extreme peril to the safety of persons and property nearby.  (4/5ths vote required)

 

SUMMARY:

 

Pursuant to California Government Code Section 8630(a) allows the County Administrative Officer, to proclaim the existence of a local emergency when the county is affected by or likely to be affected by a public calamity.  The Government Code requires that emergency proclamations be reviewed at least once every 60 days until the emergency is terminated.  

 

On November 27, heavy rainfall within the Carmel River watershed has caused conditions in the Carmel Lagoon to approach a flood stage, potentially causing damage to public roadways and other infrastructure, and areas of isolation of private property, resulting in extreme peril to persons and property.

 

Conditions of extreme peril, created by this atmospheric event, warrant and necessitate the proclamation of the existence of a local emergency and immediate action is necessary to mitigate public calamity, and to protect life and property as affected by such emergency. This board report request adoption of a Resolution of Proclamation of a Local Emergency dated December 1, 2019, in accordance with California Government Code Section 8630 et. al.

 

DISCUSSION:

 

Conditions - listed above do not comprise the total damages and impacts to the Operational Area- of extreme peril created by the atmospheric river, warrant and necessitate the proclamation of the existence of a local emergency and immediate action is necessary to mitigate public calamity, and to protect life and property as affected by such emergency; and

 

Action by the Board of Supervisors as recommended herein will document the extreme nature of the atmospheric river and its effects on the incorporated and unincorporated communities of Monterey County.

The US Army Corps of Engineers, NOAA-National Marine Fisheries Service, US Fish and Wildlife Services, CA Dept of Fish and Wildlife, CA Coastal Commission, Water Board, Resource Management Agency, County Counsel, and Office of Emergency Services.

FINANCING:

Financial impact to the General Fund at this time is unknown.
