Title

a. Approve and Authorize the Director of Health or Assistant Director of Health to sign the Automated Vital Statistics System/NET Software Agreement with the Regents of the University of California in the amount of $1,050 for the period of July 1, 2017 to June 30, 2018, for use of the Automated Vital Statistics System; and

b. Approve and Authorize the Director of Health or Assistant Director of Health to sign the Automated Vital Statistics System AVSS Technical Assistance Agreement with the Regents of the University of California in the amount of $3,000 for the period of July 1, 2017 to June 30, 2018, for provision of maintenance and technical assistance services; and

c. Accept and Approve the non-standard language and risk provisions for both the AVSS/NET Software Agreement and the AVSS Technical Assistance Agreement as recommended by the Director of Health; and

d. Authorize the Director of Health or Assistant Director of Health to sign up to three future AVSS/NET Software Agreements in the amount of $1,050 each with the Regents of the University of California, one agreement for each of FY 2018-19, FY 2019-20, and FY 2020-21, in substantially the same form as that which has been presented to the Board,  subject to approval by County Counsel and County Auditor-Controller, and so long as an appropriation for the costs of each of these Agreements is included in the County approved budget; and

Authorize the Director of Health or Assistant Director of Health to sign up to three future AVSS Technical Assistance Agreements in the amount of $3,000 each with the Regents of the University of California, one agreement for each of FY 2018-19, FY 2019-20, and FY 2020-21, in substantially the same form as that which has been presented to the Board,  subject to approval by County Counsel and County Auditor-Controller, and so long as an appropriation for the costs of each of these Agreements is included in the County approved budget.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and Authorize the Director of Health or Assistant Director of Health to sign the Automated Vital Statistics System/NET Software Agreement with the Regents of the University of California in the amount of $1,050 for the period of July 1, 2017 to June 30, 2018, for use of the Automated Vital Statistics System; and

b.                     Approve and Authorize the Director of Health or Assistant Director of Health to sign the Automated Vital Statistics System AVSS Technical Assistance Agreement with the Regents of the University of California in the amount of $3,000 for the period of July 1, 2017 to June 30, 2018, for provision of maintenance and technical assistance services; and

c.                     Accept and Approve the non-standard language and risk provisions for both the AVSS/NET Software Agreement and the AVSS Technical Assistance Agreement as recommended by the Director of Health; and

SUMMARY/DISCUSSION:

The Automated Vital Statistics System ("AVSS") was created by the University of California, Santa Barbara, to automate birth certificates and other public health records.  California hospitals, local registration districts and the California Department of Public Health use this computer-based system to produce birth certificates and register the paper documents.  AVSS enables hospitals and public health agencies to establish and maintain electronic databases containing all birth certificates that have been registered in California, and has been used in Monterey County since 1986.  These databases provide an important tool for monitoring public health trends and are an important source for reporting California vital records to the National Center for Health Statistics.  AVSS has considerably improved the timeliness and accuracy of the information collected on the birth certificate by automating production at the hospital of birth.

 

The Monterey County Health Department was one of the first counties to use AVSS in California, and was instrumental in helping to implement and sustain the program within the county's four hospitals: Natividad Medical Center, Salinas Valley Memorial Healthcare System, Community Hospital of the Monterey Peninsula and George L. Mee Memorial. 

 

The proposed Agreement is an Agreement with non-standard insurance, indemnification, and limitation of liability provisions for the County and it is recommended to seek Board of Supervisors approval.

 

This work supports the Monterey County Health Department 2011-2015 strategic plan initiatives: 1. Empower the community to improve health through programs, policies, and activities; 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services. It also supports one of the ten essential public health services, specifically: 9) Evaluate effectiveness, accessibility, and quality of personal and population-based health services.

 

OTHER AGENCY INVOLVEMENT:

County Counsel, Risk Management and the Auditor-Controller have reviewed the Agreement as to legal form, liability provisions, and fiscal provisions respectively.  Risk Management recommended seeking Board of Supervisors approval due to non-standard language.

 

FINANCING:

The AVSS/NET Software Agreement and AVSS Technical Assistance Agreement are fully paid for by birth certificate and public health records fees.  There are sufficient appropriations included in the Health Department’s (HEA003-8124) Adopted Budget for FY 2017-18.
