Approve and authorize the Director of Health or Assistant Director of Health to execute a Memorandum of Understanding (MOU) between California Correctional Health Care Services (CCHCS) and Monterey County Health Department, Behavioral Health Bureau (MCBH) for the purpose of secure transfer of Personally Identifiable Information (PII)/Protected Health Information (PHI), and/or HIPAA data between CCHCS and Monterey County via a secure file transfer portal, effective upon execution and expiring three (3) years from the date of execution.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Director of Health or Assistant Director of Health to execute a Memorandum of Understanding (MOU) between California Correctional Health Care Services (CCHCS) and Monterey County Health Department, Behavioral Health Bureau (MCBH) for the purpose of secure transfer of Personally Identifiable Information (PII)/Protected Health Information (PHI), and/or HIPAA data between CCHCS and Monterey County via a secure file transfer portal, effective upon execution and expiring three (3) years from the date of execution.
SUMMARY/DISCUSSION:
CCHCS Health Information Management (HIM) and MCBH, pursuant to California Penal Code Section 3003(e)(2), are working collaboratively to facilitate the timely and efficient release of patient-inmate medical records between CCHCS HIM and MCBH for the purpose of ensuring continuity of care/coordination of care for medical, mental health, dental, and substance use disorder treatment. CCHCS HIM and MCBH are working together to ensure secure transfer of PII/PHI.
This MOU addresses the conditions under which CCHCS and MCBH will release, exchange and use PII/PHI. The documents and information shared under this MOU will be used solely to provide continuity of care/coordination of care for health services for individuals transferred between CCHCS and MCBH. The secure file transfer portal allows PII/PHI to be shared in both directions, CCHCS to Monterey County or Monterey County to CCHCS.
This MOU contains no insurance requirements, indemnification or financial provisions as this MOU will be used solely to provide continuity of care/coordination of care for health services as outlined and in response to California Penal Code Section 3003(e)(2), for individuals transferred between CCHCS and MCBH.
This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Initiative: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services. It also supports one or more of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provision of health care when otherwise unavailable.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller have reviewed and approved this MOU as to legal form and fiscal provisions, respectively.
FINANCING:
This MOU consists of operational protocols only and thereby contains no fiscal, insurance or indemnification provisions.
