Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Chief Information Officer execute a non-standard Agreement with Black & Veatch Corporation in the maximum amount of $500,000, for the retroactive contract period of March 15, 2022 through February 14, 2024, to provide architectural, engineering, and design services to support remedial work at County radio communications sites; and

b. Approve non-standard agreement terms as recommended by the Chief Information Officer; and

c. Authorize the Chief Information Officer to sign up to two (2) amendments to this Agreement, which extend services by one (1) year each, where any increased costs do not exceed 10% of the cost of the prior year, subject to County Counsel review, and provided that the terms and conditions of the agreement remain substantially the same.

 

SUMMARY:

The County’s radio communication towers support county-wide mission critical, public safety communications. Communication tower systems are composed of facilities (tower, shelter, generators), and technology infrastructure (radios, network devices, wiring). ITD has been actively involved in updating radio sites to current safety and seismic standards for the past five years. ITD is requesting engineering services to continue to update and support radio communications sites and towers throughout the County to bring them up to standard building and safety codes.

 

DISCUSSION:

The Information Technology Department (ITD) is continually repairing deficiencies identified in the Infrastructure Readiness Study, Request For Quote (RFQ) #10527 conducted in 2017 by Black & Veatch Corporation, a consulting and construction company providing infrastructure solutions. In this report 10 County radio site locations were determined to need repairs.

 

In 2018, ITD requested and was approved to enter an agreement with Black & Veatch as a sole source vender. Black & Veatch was the only vendor that responded to the Infrastructure Readiness Study RFQ and is considered experts in infrastructure solutions. Currently, ITD is in the third phase of engineering and design services identified in the assessment.

Black & Veatch Corporation provides engineering services unique to the requirements of radio communications sites, coupled with the permitting requirements at each site, require technical engineering and design services before commencement of remediation construction.

   

The Chief Information Officer recommends entering into an agreement with Black & Veatch Corporation for architectural, engineering, and design (A & E) services to continue to upgrade deficiencies identified in the infrastructure assessment.

 

OTHER AGENCY INVOLVEMENT:

Contracts/Purchasing has approved the Black & Veatch agreement as a sole source agreement.

 

County Counsel cannot approve the Black & Veatch Corporation agreement due to the following non-standard provisions: warranty limitations; non-standard termination provisions; County obligation to pay undisputed portions of bills; non-standard insurance and indemnification provisions; non-standard royalty and work product provisions; non-standard time is of the essence provisions; non-standard force majeure provisions; and limitations the type of and amount of damages available to County in event of a breach. 

 

FINANCING:

Funds required for FY 2021-22 have been included in the FY 2021-22 Adopted Budget for the Information Technology Department, ITD 1930, Appropriations Unit INF002. Transactions relating to future fiscal years will be included in each respective Recommended Budget based upon the anticipated utilization of the services.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended Agreement for A & E services will ensure public safety communications infrastructure remains compliant with current building codes and is optimized to support daily and emergency operations.
